This Agrel'!llU!nt is dated the _ day of , I <br />1995, and is entered into by and between the City of Arden Bills, <br />a Minnesota municipal corporation (herein "Arden Hills") and the <br />Minnesota Nationa~ Gu..rd (herein .....tional Guard"). <br /> <br />2.0 Recitals. I <br /> <br />A. The National Guard owns/leases real property located <br />within the City of Arden Bills and has constructed I <br />buildings on such property (herein the ".atioual Guard <br />Site") . <br /> <br />The Nationa~ Guard wishes to extend public sewer and I <br />water facilities to the National Guard Site. <br /> <br />B. Arden Hills is in the process of determining whether it I <br />is feasible to construct certain public facilities on <br />property adjacent to the National Guard Site (herein the <br />"Arden Hi1l. Site") and would also like to extend public I <br />sewer and water to the Arden Hills Site. <br /> <br />C. A joint project consisting of mains, pUlllp houses, lift _ <br />stations, connections, hydrants, and sewer and water I <br />facility appurtenances, can be constructed in order to <br />serve both the National Guard Site and the Arden Hills <br />Site. <br /> <br />3.0 Terms and Conditions. Now, therefore, in consideration of and . <br />in reliance upon the mutual undertakings herein expressed, Arden <br />Hills and National Guard agree as follows: . <br /> <br />A. Construction of the Proiect. <br /> <br />1. The National Guard and its consultants shall . <br />prepare plans and specifications for the <br />construction of a sewer and water project to serve <br />both the Arden Hills and National Guard sites. The I <br />joint project plans and specifications shall be <br />reviewed by the Arden Hills Consulting Rngineer and <br />approved by the Arden Hills Council. <br /> <br />2.
