This letter serves as notice of appeal in regards to the proposed assessment for the 1995 Street <br /> Improvements for Benton Way and Harriet Avenue which are proposed to be placed against <br /> my property located at 1128 Benton Way, Pin No. 34-30-23-14-0019-8. <br />I The basis of this appeal is that the proposed assessments for my lot and related Homeowner <br /> Association property interests, as calculated, do not take into consideration the city's comer <br />I lot assessment reduction provisions. As a result of this oversight, the lineal footage of the <br /> project to be applied to my lot and property interests is larger than it should be and therefore <br /> the related assessment costs to be placed against my lot are greater than they should be <br />I . pursuant to standard City Assessment Policy. <br /> There are four comer lots in the project area which are involved in the calculation of the <br />I assessments to be placed to my property. These lots are formed at the points at which Benton <br /> Way and Harriet Avenue intersect. In view of the fact that the project streets forming the <br /> corners are being improved at the same time, it is clear that the City's "five year rule" must <br />I be applied in calculating the linear footage for these lots. It has been confirmed at various <br /> meetings with the City Administration and City Consulting Engineering staff that this comer <br /> lot/five year rule is applied to comer lots within the city as standard operating procedure. <br />I It has also been confirmed by the City Engineering staff in Public Hearing (July 31, 1995) <br /> on this project that the rule has not been applied to date to the subject corner lots in <br /> calculating the assessment amounts projected for placement to my property and the properties <br /> of my 67 fellow homeowner association members. It is my opinion that the City must apply <br />I the same rules to these lots in an equal status as it does as a matter of standard policy for <br /> all other corner lots within the city. <br />I The current proposed assessment to my property is computed at 1/68th of the total amount <br /> of project lineal footage abutting the Hunters Park Homeowners Association properties <br /> multiplied times $4.00 per lineal foot. When the proper comer lot reduction rules are applied <br />I as they should be, my property is entitled to a credit to lhe currently proposed assessment <br /> amount. This credit will be equal to 1/68th of the total dollar amount representing the <br /> reduction in lineal footage due the subject comer lots. <br />I m-F!?L- <br />.- <br /> Robert F.
