Mr. Ringwald indicated <br />I in the current design, only first floors would be able to have sewer, any lower levels would require <br /> injector systems if sewer was desired. <br />I Mr. Ringwald explained staffhas reviewed various options that would provide for a code consistent <br /> design and staff feels this could be accomplished if only four lots were designed and not five. <br />I Mayor Probst inquired about the triangular lot, he questioned if the lot was a conforming lot. Mr. <br /> Ringwald noted as proposed it is not, but minor modifications eould be made to establish a <br /> conforming lot. <br />I Mr. Dick Krier representing the Applicant indicated the site has various existing conditions. He <br /> noted a plan was designed to meet all the requirements of the City, but they felt it was a poor design, <br />I sacrificing trees and requiring injector systems. <br /> Mr. Krier indicated the Applicant would be willing to remove the tree within the island of the cuI-de- <br />I sac. He noted they realize the concerns with reducing the cul-de-sac, but felt it was sufficient and <br /> addressed other concerns regarding the injector systems. <br />.. Mr. Krier indicated the problem with only developing four lots is, that it would not be feasible for <br /> the project to move forward, financially. <br />I Mr. Krier stated he felt this is a unique development. Mr. Krier requested if the Council feels <br /> comfortable with this application they should approve it and if the Council feels uncomfortable to <br />I recommend returning the application to the Planning Commission. <br /> Mayor Probst inquired if this application is under the new state requirements for a time restriction. <br />I Mr. Ringwald indicated this application was made prior to July 1, 1995 and would not fall under the <br /> new requirements. <br />I Mayor Probst expressed concern that the developer is trying to put too much on the site. He <br /> commented that he liked the island in the cul-de-sac, but would prefer the full 60 foot width and <br /> without the tree. <br />I Mayor Probst indieated it was clear the Council would not negotiate, either they would deny, <br />I approve or send back to the Planning Commission. He indicated his feelings would be to return the <br /> application to the Planning Commission. <br />I Councilmember Aplikowski inquired if there is any way the developer still could have five lots. Mr. <br /> Ringwald indicated staff felt the area gained by developing only four lots would provide a code <br />I- consistent design and by moving the house pads up further from the slope, the injector systems <br />I <br />
