Education and Assistance Act" further <br /> provides in the codified law at 25 U.S.C, 45Oh(3) provides a legal mechanism for the <br /> acquisition of land wherein the Secretary of the Interior may upon request of the tribe <br /> ac;quire such land in trust for the tribe., and . <br /> WHEREAS. The Constitution and Bylaws 01 the Prairie Island Indian Community in <br /> Minnesota Artide ll-TelTitory Section 1. provides: "The Territory of the Prairie Island <br /> Indian Community shall be all land now held in trust by the United States for the <br /> Minnesota Mdewakanton Sioux Indians within the confines 01 the Prairie Island Indian <br /> Reservation. and shall include such other lands as may in the future be acquired within <br /> and without said boundary lines by the Department of the Interior or by the Community <br /> for our use in the State of Minnesota.'. and <br /> - WHEREAS. the Prairie Island Indian Community is eligible to contract for the <br /> aCquisition of lands under "The Indian Self.Determination and Education Assistance <br /> Act' (P.L. 93-638) pursuant to 25 U.S.C. 4SQ(h)3. now <br /> - <br /> THEREFORE BE IT RESOLVED. the Prairie {sland Indian Community Council does <br /> hereby request a contract for the aCQuisition of lands pursuant to "The Indian Self- <br /> - Determination, education and Assistance Act (P.L. 93-638) 25 U.S.C. 450 (h) 3' , and <br /> I . BE IT FURTHER RESOLVED, the Prairie Island Indian Community Council does <br /> hereby invoke the "Indian Sell-Determination. Education and Assistance Act (P.L. 93. <br /> 638) 25 U.S.C. 450 (h)3 " requesting the Secretary of the Interior to acquire title into <br /> - trust on behalf of the Prairie Island Indian Community to the following real property <br /> described to wit: <br /> - <br /> JI DescriptIon <br /> That property situated in Ramsey County, Minnesota described as follows: All of <br /> I Sections 9-'0 & 15, and that part of Section 16 lying nonheasterly of the center line of <br /> United States Highway N-10. all of the described property being in Township 30 N. <br /> Range 23 W. of the 4th PrinCipal Meridian, and subject to whatever rights the public <br /> may have over lhe roads and highways herein Indicated.
