<br />. <br />I. . <br /> Commenter states that the development will compromise the biological integrity of the corridor <br />. between Valentine Lake and the Ramsey County Open Space. <br />I The major impact to this corridor was the construction of Old Highway 10, a minor arterial. <br />. Commenter states that the existing hill. which is to be graded. currently provides a buffer from <br /> noise and traffic for trail users, <br />I Commenter states that the EA W does not identify the impact on the trail. that the easement is <br /> violated by several units of the project because the units have no backyard and the residents will <br /> claim a portion of the easement for a yard. Several commenters note that only Ramsey County <br />I has the right to locate the trail within the easement. <br /> A typical easement acts to prevent specific activities but does not confer absolute ownership or <br />. use rights to the easement holder. The trail will be realigned pursuant to the request of the <br /> Ramsey County Parks and Recreation Department. The trail will be relocated so that it is within <br /> the 66-foot trail easement, which is not now the case. The trail does not currently stay within the <br />I easement. The trail will follow the north property line of the project site. <br />.- The Ramsey County Parks and Recreation Department has stated that it has reviewed the grading <br /> plan and that the grading plan adequately addresses the interests of the Department. <br />I 13. Visual ImJ;lacts <br />I Several commenters state that the project will cause a visual impact viewing it from Co. Rd. E2. <br /> Valentine Lake. and the County Open Space. <br />. See response under Physical Impacts on Water Resources. <br />. Commenter notes that there are no major lights in the area and that the project will substantially <br /> affect the immediate area's night sky. <br />. The proposal does not provide for lighting on the private street.
