Mr. Jerry Filla, the Arden Hills City <br /> I Attorney, was of the opinion that the appeal was valid, based upon the policy statement <br /> outlined above, Based upon legal opinion and the present Special Use Pennit which Bethel <br /> College operates under, it is our recommendation that the appeal be granted based upon <br /> I land use and c=t drainage contribution. It is estimated that the runoff contributed from <br /> Bethel College is compazable to that of R -1 type zoning, based on comparable impervious <br /> development criteria. Bethel should, therefore, be assessed an SWM fee of $11.94 per <br /> I acre. <br /> Based upon our discussions, we recommend granting the appeal on the basis of <br /> I development, effective January 1, 1995. We also recommend granting the portion of the <br /> appeal based upon the Lake Valentine area, effective second quarter 1994, as that is the <br /> .- date the appeal was presented. <br /> We hope this letter adequately addresses your requirements regarding this issue.
