CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> I DATE: September 20, 1995 <br /> I TO: Mayor and City Council <br /> Brian Fritsinger, City Administrator@ <br /> I FROM: <br /> SUBJECT: Army Reserve Memorandum of Agreement <br /> I Request <br /> I Attached the Council will find a copy of the Memorandum of Agreement between the City and <br /> Army Reserve. This memorandum is a result of the Army Reserve's request to consider a <br /> change in the jurisdiction of the Army Reserve Site from an exclusive jurisdiction to a concurrent <br /> I jurisdiction. <br /> Background <br /> I The Army Reserve originally requested the retrocession of the Army Reserve site in 1991. This <br /> request was to share concurrent legislative jurisdiction with the State of Minnesota over the <br /> I- entire Reserve Center site consisting of 29.04 acres. <br /> Initially, the Council was concerned about this request for a number of reasons. Historically, the <br /> U.S. Army had not expressed a spirit of cooperation regarding local concerns or use of their <br /> I facilities or land for City recreational activities. The Army also ignored the City's development <br /> regulations and overlooked items addressed in the City's Planning Commission review proceses. <br /> I Police and Fire Protection <br /> During 1993 and 1994 additional conversations were held as to the retrocession request. During <br /> I this period of time it appears the major items of discussion were the provision of Police and Fire <br /> protection services. The Arden Hills City Council suggested Army representatives contact the <br /> Ramsey County Sheriffs Department and the Lake Johanna Fire Department to provide these <br /> I services and attempt to negotiate contract costs. United States Code specifically prohibits the <br /> contracting for performance offirefighting or security guard functions. Because of these Federal <br /> regulations, involved parties were unable to negotiate these contracts. <br /> I ,. <br /> The City of Arden Hills has previously recognized its obligation to provide Police and Fire <br /> services within its corparate boundaries. I have discussed this issue with representatives of the <br /> I Ramsey County Sheriffs Department and Lake Johanna Volunteer Fire Department. Neither of <br /> these agencies see any immediate need for contractural changes or increases in service fees. <br /> Obviously, future budgets may be impacted if the number of calls to the site are significant. <br /> I <br /> I- <br /> I <br />
