BBTWEBN <br />CI~Y OF ARDEN HILLS <br />I UP <br />PEPARTMEHT OF THE ARMY, <br />88TH REGIONAL 5UPPORT COMMJUltJ <br />I FORT 5l'lELLDlG, MINHESOTA <br /> <br /> <br />1.0 Parties. This Memorandum of Agreement is dated the __ <br />I day of , 19____, and is entered into by and between <br />the U.S. Department of the Army, u.s. Army Reserve, 88th Regional <br />Support Command (all aforementioned herein "88th RSC" J and the City <br />of Arden Bills (herein "Cit.y" J, a municipal corporation and <br />I political subdivision of the State of Minnesota. <br /> <br />2.0 Recitals. <br /> <br />I A. WHEREAS, t.he 88th RSC currently occupies property which <br />is within the corporate boundaries of the City and which <br />is located in the Northwest Quadrant of the intersection <br />I of Lexington Avenue and Highway 96 (herein the "Ar1IIy <br />Reserve Sit.e"); <br /> <br />B. WHEREAS, the 88th RSC has formally requested the City to <br />I consider a change in the jurisdiction of the Army Reserve <br />Site from an exclusive jurisdiction to a concurrent <br />jurisdiction; <br /> <br />I- C. WHEREAS, the 88th RSC is committed to supporting the <br />public activities of the City; <br /> <br />I D. WHEREAS, the parties desire to establish a longer term <br />and closer working relationship with each other in regard <br />to the use and regulation of the Army Reserve Site; <br /> <br />IE. WHEREAS, the Army Reserve Site is currently included in <br />an R-l Zoning District on the City' e zoning Map and <br />within an area designated as commercial on the City's <br />I Comprehensive Plan Land Use Map; <br /> <br />F. WHEREAS, the parties recognize the existing Army Reserve <br />I Site as a 1e981 , nonconforming use as defined under <br />Section IX of the City'S Zoning Ordinance, <br /> <br />G. tfBEREAS$ the Army Reserve Site will be designated as a <br />I public 'use under Section II-D.ll3 of the Arden Hills <br />Zonin9 Ordinance upon the establishment of a concurrent <br />jurisdiction; <br /> <br /> <br />I <br />I 1 <br />I- <br />I <br />
