Letter Regarding Piper Funds
Mr. Post has notified District Court that the City wishes to exclude
. itself from participation in the proposed settlement. Staff will be
investigating potential relationships with other municipalities that
have also "opted out" of the settlement. I expect Staff to approach
. the Council with some suggestions on potential future litigation at
a future meeting.
. e. Letter from Presbvterian Church of the Wav
Addressing the reuse ofTCAAP.
.. f. Letter From Midwest Asphalt
Midwest has requested the release of the $15,000 additional
. retainage held by the City. The company is working on resolving
claims, but do not appear to be moving very quickly on these
claims, Staff continues to receive phone calls from owner's whose
. vehicles were damaged while driving on County Road F. Most of
these calls focus on the lack of good faith by Midwest in resolving
the complaints. Staff has been encouraging these individuals to
. work through their insurance companies. Mr. Garski's claim has
been resolved,
. The Council should also be aware that the City has notified Liberty
Mutual that the fifty percent settlement at Valentine Park is
. unacceptable.
t'
.
