<br /> I <br /> I The Floodplain Management regulations of the City Code, in Section 9.5-18 <br /> ,. requires structures to be elevated one (1) foot above the 100 year flood elevation. <br /> The sedimentation basin has a 100 year flood elevation of 878.4 feet, which is the <br /> basins High Water Level (HWL). Therefore, the flood protection elevation (one <br /> I foot above the 100 year elevation) for this proposal would be 879.4 feet. The <br /> sedimentation basin has a Normal Water Level (NWL) of 877.5 feet. The lowest <br /> floor elevation in the Townhomes of Lake Valentine is 883.5 feet (Units 3 and 4), <br /> I which is 4.1 feet higher than the flood protection elevation, 5.1 feet higher than <br /> the HWL, and 6.0 feet higher than the NWL of the sedimentation basin. <br /> Therefore, the proposal would be in compliance with the flood protection <br /> I elevation requirements of the Floodplain Management regulations. <br /> 6. Approval of and compliance with the Minnesota Pollution Control Agencies <br /> I General Construction Storm Water Permit, including the implementation of <br /> BMP's for erosion and sediment control. <br /> The plans have yet to receive the approval of the Minnesota Pollution Control <br /> I Agency (MPCA), as outlined in their letter dated August 29, 1995 (Exhibit D). <br /> 7. Provision of a 16.5 foot buffer strip adjacent to the two wetland basins. <br /> I The Preliminary Plat (Exhibit A, page 3 of 5) delineates a 16.5 foot conservation <br /> easement adjacent to the two wetland basins. <br /> Ie 8. Payment of the park dedication fees, as determined by the City Council. <br /> The park dedication fees have yet to be determined by the City Council. The Staff <br /> I is currently reviewing the purchase agreement with the City Attorney to determine <br /> if an appraisal of the property is required, prior to the determination of the <br /> appropriate park dedication fees. <br /> I 9. Compliance with the Shoreland Management Ordinance, in particular <br /> Sections 20.5-41 and 20.5-47. <br /> I The Grading and Erosion Control Plan has been modified such that the outlet of <br /> the sedimentation basin does not outlet into Valentine Lake, but outlets into <br /> Valentine Creek. Therefore, the Shore land Management Ordinance no longer <br /> I applies to this project. However, the plan still provides for the: preservation of <br /> trees adjacent to Old Highway 10 and County Road E2; setbacks from Valentine <br /> I Lake (320 feet minimum); reduced structure heights (28.5 feet maximum); and <br /> reduced lot coverage (25 percent). These are consistent with the requirements of <br /> the Shoreland Management Ordinance. <br /> I 10.
