r=Xlti6IT D 2/z..... . I
Brian Fritsinger
Page 2 I
4. The proposed site layout for the residential lots and structures appears to have maximized ..
avoidance of wetlands completely. Subsequent proposals by individual owners or the I
association to fill wetlands should not be allowed if such proposals would conflict with the
avoidance of wetlands plan that was incorporated into this proposal. For the lots that have
wetlands within the lot boundaries, conservation easements,convenants, recorded deed I
restriction, or other acceptable permanent restrictions are required that will prohibit present
and future townhome lot owners from filling or altering wetlands on their lots. We strongly
encourage the inclusion of an appropriate buffer zone to be included in the protected area for I
the wetland.
Minnesota Rules part 4410.1700, subpart 5 require that you send us a copy of your specific I
responses to our comments. We look forward to receiving your decision on the need for an EIS.
If you have any questions regarding our comments, please contact Christy 1. Ceesay of my staff
at (612) 297-8236.
