LOT SPLIT IV ARIANCE AT 4365 LEXINGTON A VENUE - APPLICANT. <br /> DWIGHT & PENNI JO CHESNUT I <br />( I <br /> Mr. F ritsinger briefly reviewed the request for a lot split to divide a 2.33 acre tract into twO lots. -. <br />, <br />\ Mr. Fritsinger indicated the lots abut Karth Lake, which is classified as a "Namral Environment" <br /> Lake and therefore requires a 150 foot setback from the Lakes's ordinary high water line. Mr. <br /> F ritsinger noted if the setback was not moved in the lot split, this would eliminate all but a small . <br /> triangle of land on L6~ A from being buildable, and would severely limit the construction on Lot <br /> B, the applicant is requesting lake setback of 75 feet, or a variance of 75 feet. <br /> Mr. Fritsinger noted the area and dimensions of both proposed lots far exceed ordinance I <br /> reqUlrements. <br /> Mr. F ritsinger indicated the City's Comprehensive Plan has two policies on shoreland I <br /> development that could be applied. The first states that "New development...shall endeavor to <br /> comply with DNR Shoreland Standards." The second states that "as redevelopment occurs...the I <br /> City will attempt to bring new construction into compliance..." Mr. Frirsinger noted rhe plan <br /> further indicated that much of the development on Karth Lake existed at the time the shoreland <br /> regulations came into effect. I <br /> Mr. F ritsinger nOted six of the ten nearest homes co the northwesr were consrrucred after the <br /> adoption of the Comprehensive Plan and do not conform to the Lake setback requirement, he I <br /> noted generally they have lakeshore setbacks in the 65 to 90 foot range. The Karth Lake area will <br />, probably nOt be redeveloped to higher standards due to several factors: age, quality, locarion of I <br />\ streets, and topography. <br /> -, <br /> I <br />
