The sedimentation basin has a 100 year flood elevation of 878.7 feet, which is the <br />I basins High Water Level (HWL). Therefore, the flood protection elevation (one . <br /> foot above the 100 year elevation) for this proposal would be 879.7 feet. The <br />I sedimentation basin has a Normal Water Level (NWL) of 878.0 feet. The lowest <br /> floor elevation in the Townhomes of Lake Valentine is 881.0 feet (Units 3 and 4), <br /> which is I J feet higher than the flood protection elevation, 2.3 feet higher than <br />I the HWL, and 3.0 feet higher than the NWL of the sedimentation basin. <br /> Therefore, the proposal would be in compliance with the flood protection <br /> elevation requirements of the Floodplain Management regulations. <br />I 6. Approval of and compliance with the Minnesota Pollution Control Agencies <br /> General Construction Storm Water Permit, including the implementation of <br />I BMP's for erosion and sediment control. <br /> The Minnesota Pollution Control Agency (MPCA) has yet to approve the <br /> applicants request. <br />I 7. Provision of a 16.5 foot buffer strip adjacent to the two wetland basins. <br /> The approved PUD delineates a 16.5 foot conservation easement adjacent to the <br />I two wetland basins. <br />.. 8. Payment ofthe park dedication fees, as determined by the City Council. <br /> The park dedication fees was determined by the City Council to be $8,012.52 at <br /> your October 30, 1995 regular meeting. The park dedication fees must be paid in <br />I full prior to the issuance ofthe first building permit. <br /> 9. Compliance with the Shoreland Management Ordinance, in particular <br />. Sections 20.5-41 and 20.5-47. <br /> The Grading and Erosion Control Plan has been modified such that the outlet of <br /> the sedimentation basin does not outlet into Valentine Lake, but outlets into <br />. Valentine Creek. The plan still provides for the: preservation of trees adjacent to <br /> Old Highway 10 and County Road E2; setbacks from Valentine Lake (320 feet <br /> minimum); reduced structure heights (28.5 feet maximum); and reduced lot <br />. coverage (25 percent). These are consistent with the requirements of the <br /> Shoreland Management Ordinance. <br />I 10. Modification of the name of the private street. <br /> The name of the private street has been modified to Lake View Court. <br />I 11. Modification of the Townhouse Association documents, per Staff direction, <br /> for approval by the City Attorney. <br />I The City Attorney and Staff are currently reviewing the Townhouse Association <br /> documents for consistency with the previous direction given by Staff, the <br />.- Planning Commission, and the City Council. <br />. <br />
