Any required pumping of the storm pond would be the responsibility ofthe . , <br /> Townhouse Association. <br /> The plans have been modified so that the storm sewer outlet does not outlet into , <br /> Valentine Lake. Therefore the flooding potential from Valentine Lake has been <br /> eliminated. However, the responsibility for the maintenance and upkeep of the <br /> sedimentation basin and the structures should be the responsibility of the , <br /> homeowners association. <br />14. A 16.5 foot conservation easement be established and posted around the , <br /> delineated wetlands. <br /> The approved PUD delineates a 16.5 foot conservation easement adjacent to the , <br /> two wetland basins. The long-term maintenance of this 16.5 foot conservation <br /> area is provided for in the Association Documents (Declaration, Article VII, <br /> Section 3), which states:"Neither the declarant, the Association or any Owner , <br /> shall mow, cut or otherwise disturb the natural vegetation located within sixteen <br /> and one-half (16.5) feet of any delineated wetland located within the Common <br /> Elements". , <br />15. Resolution of the necessary storm sewer easement over the City property <br /> (Chatham Open Space). I <br /> The storm sewer that will be constructed through the City property (Chatham <br /> Open Space) will be, after it is accepted, a City utility. Therefore, it would be <br /> inappropriate for the City to grant an easement to itself. However, it would be I <br /> appropriate for the City to agree with the location of the storm sewer and to <br /> require restoration of the City property after the construction of the storm sewer. , <br /> The City agreed to the location of the storm sewer when the City approved the <br /> PUD. The development agreement for the Townhomes of Lake Valentine <br /> includes a clause (Section 4.01, A, 2) requiring that the developer seed or sod all , <br /> disturbed areas outside of the right-ol~way within ten (10) days of the completion <br /> of the grading. <br />17. Deletion of Units 7, 8, 15, and 16 and the Southerly relocation of the , <br /> Northwesterly portion of the private street (Lake View Court), so as to <br /> maximize the distance between the 66 foot easement and Units 5 and 6. I <br /> Units 7, 8,15, and 16 have been deleted. The private street has been relocated <br /> Southerly to maximize the distance between the units and the 66 foot easement. <br /> The distance between Units 5 and 6 and the 66 foot easement is now at least 24.5 I <br /> feet. <br /> - , <br /> I <br />
