The applicant shall perform a noise analysis to4lt I <br /> 2 determine whether upon establishment of the_ <br /> 3 heliport or helistop the Noise Pollution Control <br /> 4 Rules, Chapter 7010, of the Minnesota Pollution <br /> 5 Control l>.gency, would imm~diately be violated. If I <br /> 6 the analysis shows that the rules would be <br /> 7 violated, the applicant shall take measures to <br /> 8 prevent the potential violation before the - <br /> 9 heliport or helistop is established. I <br /> 10 <br /> 11 c. The heliport or helistop shall be constructed, <br /> 12 operated and maintained in accordance with the I <br /> 13 rules and regulations of the Federal Aviation <br /> 14 Administration (FAA) and State of Minnesota. <br /> 15 Documentation that the FAA and state have approved <br /> 16 the heliport or helistop shall be included with I <br /> 17 the ~EP~ication. <br /> 18 <br /> 19 d. A site plan of the proposed facility and an area I <br /> 20 map showing the distance between the proposed <br /> 21 take-off and landing area and the nearest <br /> 22 residential property shall be provided to the <br /> 23 commission. I <br /> 24 <br /> 25 (10) Overnight shelters as permitted and regulated in the B- <br /> 26 5 Central Business-Service District. ~ <br /> 27 Municipal and commercial yard waste sites for storage, I <br /> 28 (11) <br /> 29 transfer or composting of yard waste, subject to the <br /> 30 following conditions: I <br /> 31 <br /> 32 a. Only yard waste and no other types of solid waste <br /> 33 shall be accepted; <br /> 34 I <br /> 35 b. The municipal or commercial yard waste site shall <br /> 36 be lOcated no closer than three hundred (300) feet <br /> 37 fram any residentially used or zoned property as I <br /> 38 measured from the edge of the nearest compost pile <br /> 39 to the nearest residentially used or zoned <br /> 40 property; <br /> 41 I <br /> 42 c. The municipal or commercial yard waste site shall <br /> 43 be enclosed by fencing or shall limit vehicular or <br /> 44 p~destrian access through the USe of berms, trees I <br /> 45 or other means. The site may have greenhouses for <br /> 46 composting yard waste; <br /> 47 <br /> 48 d. The height of the compost pile shall be limited to I <br /> 49 no higher than fifteen (15) feet above grade; and <br /> 50 <br /> 51 e.
