Violation Rate - the number of drivers found during random tests given pursuant <br /> 107 to this policy and federal regulations to have an alcohol concentration of 0.04 or <br /> I greater, plus the number of drivers who refuse a random test required by this <br /> policy and federal regulations, divided by the total reported number of drivers in <br /> I the industry given random alcohol tests pursuant to this policy and federal <br /> regulations, plus the total reported number of drivers in the industry who refuse a <br /> random test required by this policy and federal regulations. <br /> . 4. PROHIBITED CONDUCT <br /> Conduct Related to Alcohol <br /> I 382. (a) A driver tested under this policy and federal law who is found to have an alcohol <br /> 505 concentration of 0.02 or greater but less than 0.04 shall not perform safety <br /> sensitive functions, including driving a commercial motor vehicle. The driver <br /> I shall not perform safety sensitive functions until the start of the driver's next <br /> regularly scheduled duty, but not less than twenty-four (24) hours following <br /> administration of the test and driver will not be compensated during the time off. <br /> I The driver may use benefit hours during the absence if accrued and available. A <br /> detectable alcohol concentration level is in violation of the City of Arden Hills <br /> .- Drug and Alcohol Testing Policy and actions also may be taken under that policy, <br /> which may be in addition to this policy. <br /> 382. (b) No driver shall report for duty or remain on duty requiring the performance of <br /> . 201 safety sensitive functions while having an alcohol concentration of 0.04 or <br /> greater. <br /> . (c) The City, having actual knowledge that a driver has an alcohol concentration of <br /> 0.04 or greater, shall not permit the driver to perform or continue to perform <br /> I safety sensitive functions. <br /> 382. (d) No driver shall be on duty or operate a commercial motor vehicle while the driver <br /> I 204 possesses alcohol in any quantity, (also including cold remedies, i.e., NyQuil). <br /> 382. No driver shall use alcohol while performing safety sensitive functions. <br /> (e) <br /> I 205 <br /> 382.
