(i) No driver required to take a post-accident alcohol test because ofloss of human I <br /> 209 life or who receives a citation under state or local law for a moving traffic <br /> violation arising from an accident, shall use alcohol for eight (8) hours following <br /> the accident, or until the driver undergoes a post-accident alcohol test, whichever I <br /> occurs fIrst. <br /> 382. m No driver shall refuse to submit to a post-accident test, a random alcohol test, a I <br /> 211 reasonable suspicion test, or a follow-up alcohol test mandated by this policy and <br /> federal law. <br /> (k) The City shall not permit a driver who refuses to submit to the mandated alcohol I <br /> tests under this policy and federal law to perform or continue to perform safety I <br /> sensitive functions. <br /> Conduct Related to Controlled Substances -. <br /> 382. (a) No driver shall report for duty or remain on duty requiring the performance of <br /> 213 safety sensitive functions when the driver uses any controlled substance, except <br /> when the use is pursuant to the instructions of a physician who has advised the I <br /> driver that the substance does not adversely affect the driver's ability to safely <br /> operate a commercial motor vehicle. <br /> 382. (b) The City, having actual knowledge that a driver has used a controlled I <br /> 213(b) substance, shall not permit the driver to perform or continue to perform a safety <br /> function unless use is permitted pursuant to the written instruction of a physician. I <br /> 382. (c) A driver shall inform the driver's supervisor of any therapeutic drug use. <br /> 213(c) I <br /> 382. (d) No driver shall report for duty, remain on duty, or perform a safety sensitive <br /> 215 function, if the driver tests positive for controlled substances. . <br /> 382.
