<br />I <br />I. presence of the drug(s) or drug metabolic(s) found in the primary specimen. The <br /> split specimen shall be retained in long-term storage for one year by the <br />. laboratory conducting the analysis of the split specimen. - <br />. Reporting and Review of Results for Controlled Substance Testing <br /> 40.33 (f) <br /> (a) Confirmation Retest. The MRO shall notify each driver who has a confirmed <br />I positive test that the driver has 72 hours in which to request a test of the split <br /> specimen if the test is verified as positive. The driver will be responsible for all <br /> costs associated with the confirmatory retest unless results are negative. If the <br />. driver requests an analysis of the split specimen within 72 hours of having been <br /> informed of a verified positive test and the analysis of the split specimen fails to <br /> reconfirm the presence of the drug(s) or drug metabolite(s) that were originally <br />. found in the primary specimen, or if the split specimen is unavailable, inadequate <br /> for testing or untestable, the MRO shall cancel the test and report the cancellation <br /> and the reasons for it to the DOT, the City and the driver. <br />I 40.33 (g) <br /> (b) MRO shall direct the analvsis of split specimen. If the driver has not contacted the <br />. MRO within 72 hours of having been informed of a verified positive test, the <br /> driver may present to the MRO information documenting that serious illness, <br />I- injury, inability to contact the MRO in a timely manner. Ifit is determined that <br /> the driver did have a legitimate explanation for not contacting the MRO, the MRO <br /> shall direct the analysis of the split specimen, as applicable, be performed. <br />. (c) MRO is unable to contact the Driver. If, after making reasonable efforts and <br /> documenting those efforts, the MRO is unable to reach the driver directly, the <br />. MRO must contact the designated City contact person, who shall direct the driver <br /> to contact the MRO. If the City contact person is unable to contact the driver, the <br /> driver will be placed on suspension. <br />. (d) MRO mav verify a Positive Test. The MRO may verify a positive test without <br /> having communicated directly with the driver about the test results under the - <br />I following circumstances: <br /> (1) The driver expressly declines the opportunity to discuss the test results. <br />. (2) The driver has not contacted the MRO within five (5) days of being <br /> instructed to do so by the City. <br />. 7. ALCOHOL TESTING <br /> The FWHA alcohol testing rules require breath testing to be administered by a <br />. Breath Alcohol Technician (BAT) using an Evidential Breath Testing Device <br /> (EBT). Two (2) breath tests are required to determine if a person has a prohibited <br />.- 16 <br />. <br />-----..- <br />
