<br /> . I <br /> (1) Temporary Emplovees. Temporary employees as defined in the City of .1 <br /> Arden Hills Personnel Policy shall have no right to appeal. I <br /> - <br /> (2) N on- V eterans on Probation. An employee who has not completed the <br /> probationary period and who is not a veteran, has no right to appeal. I <br /> (3) Non-Veterans After Probation. A regular employee who has completed the <br /> probationary period and who is not a veteran, has a right to appeal to the I <br /> City Administrator no later than 15 calendar days of the action, or the <br /> employee may utilize the grievance procedure included in the applicable I <br /> collective bargaining agreement. <br /> (4) Veterans. An employee who is a veteran has a right to appeal to the City I <br /> Administrator, a permanent demotion (including salary decreases), or a <br /> discharge, if the employee submits a notice of appeal within sixty (60) <br /> calendar days of the action, regardless of status with respect to the I <br /> probationary period. An employee who is a veteran may have additional <br /> rights under the Veterans Preference Act, Minn. Stat. 197.46, and as such <br /> will be notified by the City in writing of any proposed disciplinary action. . <br /> (b) All notices of appeal not covered under a collective bargaining agreement must be -. <br /> submitted in writing to the City Administrator, 1450 Hwy 96, Arden Hills, MN <br /> 55 112, and shall be provided an appropriate hearing. <br /> (c) An employee who is covered by a collective bargaining agreement which was I <br /> entered into prior to this policy and included drug testing regulations and I <br /> procedures may elect to seek relief under the terms of that agreement by <br /> contacting the appropriate union and initiating grievance procedures in lieu of <br /> making an appeal to the City Administrator. I <br /> 13. GOOD FAITH EFFORT <br /> The City of Arden Hills will make a continuing good faith effort to maintain a -- <br /> . <br /> drug-free workplace through the implementation of the City of Arden Hills <br /> Implementing the Federal Omnibus Transportation Employee Testing Act and <br /> Related Regulations. I <br /> This policy implementing the Federal Omnibus Transportation Employee Testing . <br /> Act is based upon final federal regulations at the time of adoption of this policy. <br /> Any revisions in the federal rules shall take precedence over this policy to the <br /> extent that the policy has not incorporated the revised rules. . <br /> 21 -. <br /> I <br />
