<br />. <br /> <br />. <br /> <br />. <br /> <br />- ARDEN HILLS CITY COUNCIL - February 13, 2006 <br /> <br />6 <br /> <br />Council member Holdeu asked if they could require a condition that would inelude a noise plan. <br />Mr. Lehnhoff responded they could revise condition 6 to say: The applicmt shall be required to <br />install noise mitigation measures if the City receives complaints regarding noise generated by the <br />unit and the complaints are validated by City Staff for the decibels levels not to exceed 73 <br />decibels, at 30 feet from the unit. <br /> <br />MOTION: Mayor Aplikowski moved and Councilmember Grant seconded a motion <br />to approve the amendment to Condition 6. The motion carried <br />unaJlimously (4-0) <br /> <br />The original motion carried (3-1 Councilmember Holden opposed). <br /> <br />F. Planninl! Case #06-004: St. Paul Lodl!e #2 I.O.O.F. (Odd Fellows), 1174 Edl!ewater <br />Avenue North - Minor Subdivision and Consolidation <br /> <br />Mr. Lehnhoff stated the applicants own a 1.54 acre property at 1174 Edgewater Avenue North. <br />On March 8, 2005, the City Council approved an amendment (Case 05-03) to the Lodge's <br />original Special Use Permit #70-36. The amendment allowed the Lodge to reduce the size of <br />their parking lot with the intent of selling three lots on the eastern edge of the property. The <br />amendment was approved with seven conditions. Condition three is the reason for this minor <br />subdivision and consolidation application. Lots 1, 2, and 3 are all non-confonning in the R-2 <br />Zone with slightly less than 5,000 square feet each. However, when combined, the three lots <br />meet the minimum requirements of the R-2 Zone. In order to eliminate the potential of <br />development on each of the three individual, non-conforming lots, the City has required the <br />applicant to consolidate the three lots into one conforming lot. This applicmt seeks to complete <br />condition three of Planning Case 05-03. <br /> <br />He noted at the regular Planning Commission meeting of Febmary I, 2006, the Commission <br />voted unanimously to recommend approval of the minor subdivision and consolidation subject to <br />five conditions as noted in staffs February 6, 2006 report. <br /> <br />Council member Graut stated it seemed wrong to him to base the value of these parcels on the <br />value of land that has a substmtial amount of lakefront considering these parcels did not have <br />lakefront. He stated he was in favor of basing the value on surrounding lots of similar size. He <br />indicated he was in support of staffs calculation of $4,896.00 for the park dedication fee and he <br />would not be in favor of waiving the park dedication fee in this case because this was a <br />requirement of other applicants and he did not see the reason to totally waive the park dedication <br />fee. <br /> <br />Couneilmembers Holden and Pellegrin agreed with Councilmember Grant's recommendation. <br /> <br />H. R Pogue, Treasurer, St. Paul Lodge #2, I.O.O.F., stated he had written up his memo at <br />staffs direction. He noted he had forgotten to add in an added expense of putting in a concrete <br />curb in the new parking lot and put landscaping around that are, which would be another $5,000 - <br />
