CONSENT ITEM - 8E
'It
-731EN HILLS
MEMORANDUM
DATE: May 28, 2024
TO: Honorable Mayor and City Councilmembers
Dave Perrault, City Administrator
FROM: Jessica Jagoe, Community Development Director
SUBJECT: 1475 Dawn Circle Variance Extension — Joshua and Carolyn Haberman
Budgeted Amount: Actual Amount: Funding Source:
N/A N/A N/A
Council Should Consider
Motions to approve, table, or deny the following:
• A 6-month extension until November 22, 2024 for the deadline to be issued City permits for
the approved garage addition from Planning Case 23-008.
Background
On May 22, 2023, the City Council approved Planning Case 23-008 from Steve Petry of Advanced
Drafting and Res. Design Inc. on behalf of property owners Joshua and Carolyn Haberman for a
Variance at 1475 Dawn Circle. The Variance included decreasing the required total side yard
setback from 25 feet to 20.33 feet for the construction of a garage addition. Conditions of approval
include a requirement that a building permit shall be issued prior to the commencement of
construction. The Variance approval automatically expires one year from and after the date on
which the City Council granted such approval if permits are not issued. The one year deadline for
issuance of a permit is May 22, 2024.
The Applicants have stated that due to conditions outside of their control, it has been more difficult
to get firm bids for the project. They now have signed a contract with a contractor, Becker
Construction & Remodeling Inc., and will initiate construction as soon as scheduling allows. The
Applicants are requesting a 6-month extension until November 22, 2024, for the issuance of
applicable City permits.
Budget Impact
N/A
Attachment
Attachment A — Request for Extension
Page 1 of I
