Properties, LLC and the building is occupied by the Northern Lights Bingo Hall and Bright Side <br />Cafe. The Applicant is proposing to renovate the existing building and resurface the parking lot. <br />The Applicant is proposing a phased development with the event center established in Phase I and <br />restaurant and adult day care uses to be established in Phase II and Phase III, respectively. The <br />Applicant is seeking review and approval for Phases I and II at this time. <br />Approvals <br />1. Zoning Code Amendment <br />The Applicant is proposing to use the property as an Event Center. Currently, the city code is <br />absent of land use language permitting an Event Center use or establishing standards for the <br />development or operation of an event center within any zoning district. To allow this land use, the <br />City's Zoning Code would need to be amended to add a definition for an Event Center and to <br />designate this type of land use within a zoning district. The proposed Event Center would not be <br />permitted without a zoning code amendment. <br />As part of the land use application, the Applicant has proposed for the use of an event center to be <br />allowed in the B-2 General Business Zoning District through a conditional use permit. The <br />Applicant has stated that the addition of an event center as a conditional use in the B-2 Zoning <br />District aligns with the districts purpose of accommodating commercial activities that serve the <br />local community. The other approvals noted in the land use application would not be applicable <br />unless the Event Center use is permitted within the B-2 General Business Zoning District. <br />2. Planned Unit Development <br />A Planned Unit Development (PUD) is required for all new development and redevelopment in <br />the B-2 Zoning District. In addition, a PUD would allow for performance standard flexibility. This <br />proposal involves both the initial Master Plan PUD and the Final PUD for Phase I and II. Under <br />the PUD Master Plan, the Applicant shall provide details for each stage of development, but would <br />be required to seek the PUD Final Plan approval of Phase III at the time of establishing the future <br />use of an adult day care. The Applicant has provided details in the Architectural Plans which <br />identifies how the Subject Property would be utilized in Phase I as an event center, Phase II as a <br />restaurant, and Phase III as an adult day care. The City Council should consider the different phases <br />of development while considering the Master and Final PUD as proposed in this application. In <br />this application, the Applicant is seeking approval for Phase I, the event center, and Phase II, which <br />includes the restaurant. The Applicant states in the narrative that Phase II would begin immediately <br />after the completion of Phase I for the event center with the restaurant being operational once a <br />liquor license is obtained. <br />3. Conditional Use Permit <br />The Applicant is proposing that in the B-2 Zoning District, a Conditional Use Permit is required <br />for an event center. Typical factors to consider in the evaluation of the CUP request may be hours <br />of operation, potential noise from the proposed use, lights from vehicles, and on -site traffic. The <br />Applicant is proposing all events will be held inside the building to contain noise within the venue <br />and their request includes supplementary materials related to a security plan and traffic <br />considerations. <br />Page 2 of 7 <br />
