Watershed District, noting that underground storage chambers would be utilized in addition to the <br />sedimentation pond for controlling the rate of discharge and filtering out sediment. Catch basins <br />would collect surface drainage and direct it toward the sedimentation pond or to the underground <br />storage chambers. Treated stormwater would be discharged into a nearby wetland basin. <br />The Applicant's stormwater management plan is subject to Rice Creek Watershed District review <br />prior to the Final Plat. Staff has shared the Applicant's plans with RCWD and the Applicant has <br />been directed to work with RCWD regarding drainage and utilities prior to the final plat review. <br />Rezoning <br />The Applicant is requesting to rezone the 10.74 acre Lot 2, Block 1 parcel shown on the <br />preliminary plat from B-1 Limited Business District to R-4 Multiple Dwelling District to be <br />consistent with the site's guiding as High Density Residential in the 2040 Arden Hills <br />Comprehensive Plan. <br />The Zoning Code includes the following purposes of the R-4 Multiple Dwelling District - <br />1. To establish areas for the development of multiple dwelling structures with a maximum <br />density of twelve (12) units per net acre; <br />2. To permit the most intensive residential development allowed in the City; and <br />3. To maintain an essentially residential character in areas developed at a more intensive <br />density. <br />Parcels zoned for the R-4 Zoning District are subject to the zoning requirements as noted in the <br />Land Use Chart and the District Requirements Chart. As shown in the evaluation of the proposed <br />preliminary plat, the 10.74 acre parcel meets the requirements for lot dimensions in the R-4 Zoning <br />District. Future improvements to the parcel would be subject to the district requirements for the R- <br />4 Zoning District and shall be evaluated when a land use application for development is initiated. <br />The Applicant states that the intended use for the 10.74 acre parcel is a single, 3-story building <br />with approximately 122 for an age -restricted (55+) active senior apartment community. In the <br />Zoning Code, dwelling, multiple family is a use that is permitted in the R-4 Zoning District through <br />a conditional use permit. Future applications that include a multi -family dwelling use would be <br />evaluated according to the R-4 density and development requirements as well as the conditional <br />use permit criteria. These criteria shall be evaluated when a land use application for this type of <br />development use is initiated. <br />The Planning Commission's review of this rezoning request should also consider the following: <br />1. Conformity with Comprehensive Plan <br />2. Substantive changes that have occurred making the zoning change necessary <br />3. Demonstration showing that the change is superior to the current Zoning and/or <br />Comprehensive Plan <br />4. Development conditions or priorities that make the existing Zoning and/or Comprehensive <br />Plan impractical <br />In July 2022, the City approved and adopted a Comprehensive Plan Amendment to guide the <br />subject 10.74 acre parcel for High Density Residential use which provides for densities of nine <br />Page 7 of 10 <br />
