September 28+ 1959 <br /> 3 <br /> ~ Attorney&s Report: Mr. Courtney stated that he had spent considerable <br /> time with Mrs. Patterson in regard to the Patterson matter. as she feels <br /> the turnaround easement will unduly penali~e her property. He sugges tad <br /> that Mr. Carley have a talk with her and try to come to some sort of <br /> equitable agreement with her concerning the easement as condemnation <br /> proceedings are possible but expensive and necessarily involved. Mr. <br /> Carley to check with her. <br /> ~ Mr. Courtney stated that on the Kranak bond there are no specifications <br /> attached to the bond and no time of completion has ever been set for <br /> finishing the roads in Shorewood Hills #6. Mayor stated that we ao have <br /> in the official minutes of the Village a request that he furnish us with <br /> a bond and complete the roads upon Council request and that the specifica- <br /> tions are in the ordinance. No action was taken on matter. <br /> Attorney courtney presented the Clerk's office with a letter regarding the <br /> purohase of the Village Hall from the Village of Mounds View, dated Sept. <br /> 25, 1959. The Hall now belongs to Arden Hills with all papers in order. <br /> Mr. Courtney said that the Joseph Besch matter poses a serious questiopas <br /> to who has responsibility for covering him as he was an uncompensated <br /> Eivil Defense worker. It could be Ramsey County, Ramsey County Civil <br /> Defense or the Village of Arden Hills. The attorney advised that the <br /> Village handle the matter under the provisions of Seotion 176.191 of the <br /> MinD.eota Statutes. He felt that the Village should not acoept responsi- <br /> ~ bility as if we do. our workmen's oompensation premiums will go up beoause <br /> the rate will reflect all Arden Hills Civil Defense volunteers. He feels <br /> that the Village should let the Industrial Commission decide responsibility. <br /> He suggested that the village deny the claim and let our insuranoe oompany <br /> undertake the defense. The Industrial Commission is willing to handle <br /> Besoh's defense in order to avoid a charge to anyone for attorney's fees. <br /> The Council felt that compensation benefits should be made available to <br /> Mr. Besch as soon as possible. The Council recommended that Village <br /> attorney notify our insurance oompany and Ramsey County of their position <br /> on the matter according to attorney reoommendations. <br /> Mr. Weber Jleported that Mrs. Besch has been in need of ready oash and two <br /> Civil Defense members have advanced her $300.00. The Arden Hills Police <br /> Department and Civil De#ense Unit are sponsoring a drawing on a TV set <br /> whioh they hope will raise $1.000.00, the proceeds to be turned over to <br /> her. <br /> Dr. Watz suggested that if the Village is to cover their Civil Defense <br /> ~ Unit under their own insurance policy that a specific distriot or area <br /> be set up where this unit will be covered. <br /> Mr. Co~tney presented an ordinance accepting the provisions, terms and <br /> conditions contained in Ordinance No. l0725 of the City of st. Paul. as <br /> amended. and Ordinance No. ~~3 of the Village of Roseville. whioh ordinance <br /> was passed September 22, 19 . all relating to the conneotion by the Village <br /> ~ of Arden Hills to the publio sanitary sewer system of the Village of RB.e- <br /> ville. Roseville has requested that a copy of Arden Hills ordinance <br /> aocepting their ordinance, duly authorized and oertified. be on file in <br /> the office of Clerk before Ootober 6 so that they may accept the st. Paul <br /> ordinance before October 11. <br />
