Olen. 3270 Hamline Avenue. submitted a petition with many signers <br /> opposing apartments. Mayor Kennedy read the petition and referred it <br /> to Trustee Nethercut for the Planning Commission and then to be returned <br /> to the Village files. Matter of rezoning referred to the Planning <br /> Commission. <br /> Liquor License AfPlications <br /> Atty. Courtney 1 sted in his letter several discrepancies and/or omission <br /> in the liquor license applications and/or bonds. Referred to Clerk far <br /> proper completion. <br /> ~Trustee Crepeau moved. seconded by Trustee Nethercut. that the 1965 <br /> liquor licenses be granted. subject to the approval of the Attorney and <br /> the Police and Fire Departments. for the following establishments: <br /> McGuire's Supper Club, Inc. - on and off-sale liquor licenses <br /> Lewis W. Lindemer - on and off-sale liquor licenses <br /> Big Ten Supper Olub, Inc. .. on and off-sale liquor licenses <br /> Flaherty's Arden Bowl, Inc. - on-sale liquor license <br /> motion carried. <br /> Uniform BUilding Code <br /> Atty. vourtney reported that he still does not hRve the printed copy of <br /> the Uniform Building Code with amendments as passed by White Bear. <br /> Atty. Courtney recommended that the Uniform Building Code and the new <br /> Zoning Ordinance be accepted by the Village before the acceptance of <br /> the codification of the ordinances as many of our present ordinances <br /> are outdated and many others will be dropped. <br /> Mayor Kennedy suggested that the new books on ordinances be placed in <br /> a loose leaf type book to facilitate keeping the ordinances current. <br /> Butane Tank Matter <br /> Atty. Gourtney reported that Lester Wilsey, 1178 Tiller Lane. was <br /> found not guilty of a Village Ordinance violation by the location of <br /> a butane tank on his property closer to the property line that the <br /> Ordinance allows. JUdge Fleming, White Bear Court, determined that, <br /> according to our Ordinance, the butane tank does not constitute a <br /> structure. Atty. requested to send a copy of the Judge's determln~ <br /> ation to the Council and also to Carl Dale, Village Planner. <br /> Atty. Courtney informed the Council that this decision is not appeal- <br /> able. but the Village could start civil action u[jder the statutes, <br /> probably to the Ramsey County District Court. and if this court makes <br /> the same determination, our Ordinance should be re-written. <br /> Proposed Rezoning - County Rd. E & Snelling Ave. <br /> MayorKennedy read a memorandum from Carl Dale, Village Planner, with <br /> his reasons for recommending that the property on the northwest corner <br /> of County Road E and Snelling Avenue be rezoned from commercial to <br /> 4Itresidential. The Council and Atty. agreed that Mr. Dale's reasons <br /> were very good. ' <br /> Clerk Lorratne Stromquist informed the Council that a letter sent to <br /> Carl Moen, owner of the property, Was returned with a notation fram <br /> Mr. Moen that he sold the property on November 11. but he did not <br /> gi ve the name of the purchaser. <br /> Trustee Nethercut moved, seconded by Trustee Crepeau, that a public <br /> hearing for the rezoning of this property be held on January 2~. 1965, <br /> and that Atty. Courtney be authorized to prepare the legal notices, <br /> publication and ownership report; motion carried. <br /> -2= <br />
