Who ensures potency of product? <br />The OCM is establishing a statewide monitoring system that will track all cannabis <br />products. Manufacturing of product requires recordkeeping that includes the date the <br />activity was completed; the name of the worker completing the activity, or the name for <br />the responsible worker when more than one worker; the process step or description of the <br />activity that was completed; relevant process control measurements; and batch number. <br />Can events be prohibited? <br />Staff believes that events can be prohibited, however, this should be done outside of zoning <br />and through an event permit of some kind. For reference, Minnesota State Statute 342,39 <br />Cannabis Event Organizer Licensing Subd. 2(7) requires that an event organizer provide <br />proof of local approval for a cannabis event. The City could not prohibit a cannabis event <br />organizer from establishing a business in the City, but staff believes that the use would <br />function like an office with regulations applied by the OCM. <br />• Can municipalities establish cannabis retail stores? <br />Municipalities can establish municipal cannabis retail stores, however, if the City operates <br />a municipal store, one other registration must be allowed. <br />Could a zoning overlay be implemented to address the uses? <br />An overlay district could be used to implement the zoning standards, however, what the <br />boundaries and applicability of the overlays would need to be determined. Most cities that <br />staff have reviewed are incorporating zoning standards into existing districts. <br />Can the City impose operational procedures for businesses such as multiple point ID <br />verification? <br />Minnesota State Statute 342.13 establishes standards for local control and states: <br />o A local unit of government may not prohibit the possession, transportation, or use <br />of cannabis flower, cannabis products, lower potency hemp edibles, or hemp - <br />derived consumer products authorized under this chapter. <br />o Except as provided in section 342.22, a local unit of government may not prohibit <br />the establishment or operation of a cannabis business licensed under this chapter. <br />o A local unit of government may adopt reasonable restrictions on the time, place, <br />and manner of the operation of a cannabis business provided that such restrictions <br />do not prohibit the establishment or operation of cannabis businesses. <br />The City may impose standards for the manner of the operation of a cannabis business. If <br />the Council has direct input as to what operation should look like, staff will research those <br />standards and provide an evaluation on the reasonableness and a report on if the OCM <br />regulates the manner of operation. Currently the OCM draft rules regulates sale by the <br />following: <br />Subp. 2. Age verification. <br />A. Retailers must confirm that individuals within the retail area are 21 years of <br />age or enrolled in the medical cannabis patient registry — or their registered <br />caregivers. <br />B. Retailers must confirm an individual's age or enrollment in the medical <br />cannabis patient registry at the time of sale of any item regulated by the office. <br />Page 5 of 6 <br />
