Hemp Flower and Hemp-Derived Cannabinoid Product Checklist 4 <br />Question Yes No Comments Additional Information <br />Does the business sell any edible <br />products in the shape of bears, <br />worms, fruits, rings, ribbons? <br /> Edibles in shapes that appeal to children are not allowed. <br />Is the edible product in a child- <br />proof, tamper-evident, opaque <br />container? <br /> All edibles must be in a container that is child-resistant and <br />tamper evident. If the container is clear, the business must <br />place the edible into an opaque bag at the point of sale. Clear <br />bags are not allowed. <br />Product Compliance - Beverages <br />Does the beverage product <br />contain more than 5 mg delta-8 <br />or delta-9 per serving? <br /> Beverages may not exceed 5 mg delta-8 and/or delta-9 per <br />serving. <br />Does the beverage product <br />contain more than 2 servings? <br /> Beverages cannot exceed two servings, regardless of the THC <br />potency. <br />Is the beverage product in an <br />opaque container? <br /> If the beverage is in a clear container, the business must place <br />the beverage in an opaque bag at the point of sale. <br />Product Compliance – Smokables (non-flower) <br />Does the business sell vapes, pre- <br />rolls, dabs, or other smokable <br />products which contain more <br />than 0.3% THC? <br /> A product’s certificate of analysis will show the concentration <br />of THC the product contains. The certificate typically is found <br />through the QR code on the product package. In MDH’s <br />experience, most vapes contain 50% - 90%+ THC. <br />Pre-rolls may consist of raw hemp flower. These products are <br />not regulated by 151.72. However, if a pre-roll is labeled as <br />“infused” or “coated” have additional cannabinoids applied to <br />the material, of which the product typically exceeds the 0.3% <br />THC limit.
