At this time, there is not an <br />approved statement. <br />Does the label on the product <br />state that the product does not <br />claim to diagnose, treat, cure or <br />prevent any disease? <br /> The manufacturer cannot claim the product will provide any <br />health benefit unless the product has been formally approved <br />by the FDA. <br />Does the business sell CBD (or <br />other forms of cannabidiol) in <br />the form of a softgel, tablet, or <br />tincture? <br /> Non-intoxicating cannabinoids may only be sold in the form of <br />an edible, beverage, or topical. Therefore, softgels and tablets <br />cannot be sold. Tinctures must be labeled as either an edible or <br />beverage and comply with the edible or beverage <br />requirements. <br />Product Compliance – Edibles <br />Does the edible product contain <br />more than 5 mg delta-8 and/or <br />delta-9 per serving? <br /> Edibles may not exceed 5 mg delta-8 and/or delta-9 per <br />serving. <br />Does the edible product <br />package/container contain more <br />than 50 mg total THC (delta-8 <br />and/or delta-9)? <br /> Edibles may not exceed 50 mg total delta-8 or delta-9 per <br />package. The edible cannot contain any other form of THC or <br />intoxicating cannabinoid. <br />Are all the edible product’s <br />servings clearly marked, <br />wrapped, or scored on the <br />product? <br /> Edible product servings must be clearly distinguished on the <br />product. Bulk products that require the consumer to measure <br />are not allowed.
