Commencing at the point of intersection of the South line of the aforedescribed parcel and a line parallel to and 165 feet SW'ly of the SW'ly right-of-way line of S.T.H. 10, thence NW'ly along said line lying parallel to and 165 feet SW'ly of said SW'ly right- of-way line S.T.H. 10 to its intersection with a line run SW'ly and at right angle from a point on the centerline of said S.T.H. 10 and 940.2 feet NW'ly, measured thereon, from the East line of the SW 1/4 of Sec. 16, T. 30, R. 23, thence NE'ly along the last described line to the NE'ly line of the aforedescribed parcel and there terminating. A further temporary construction easement 30 feet in width lying SW'ly of and NW'ly of the aforedescribed perpetual easement and adjoining it. WHEREAS, the Council has been unable to purchase said land from the owner, Josephine Waldoch, at a price deemed by the Council to be favorable, and WHEREAS, the Village is advised and believes that the most feasible location for such sanitary sewer is on the land above described, and WHEREAS, by reason of the inability to purchase said land, it has become necessary to procure said land by right of eminent domain, NOW THEREFORE, BE IT RESOLVED, that the Village of Arden Hills proceed to procure title to said land under its right of eminent domain and that the Village Attorney be instructed and directed to file the necessary complaint therefor and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; that the Village Attorney, the Mayor and the Clerk do all things necessary to be done in the commencement, prosecution and successful termination of such action.
