(1) .An area Immedletely N. & S. ot Hwy 96 and between Hwy 10 & 35W - Geo.
~ndyklewlcz - an excevatlng operetlon, removing and stockpiling topsoil
and black dirt for landscaping purposes. Excavations are shallow end
do not present a hazard to the general public. Stock piles are rela-
tively low In height and, unlike sand, do not present a danger from
shifting or failing materials due to the steepness of slope. ExcaV-
ation being deeper than 2' a permit would be required under Sec. 7003
of the Uniform Building Code. Exception to this requirement Is pro-
vided In paragraph 5 and 6 of this SeC. 7003 - par. 5 - which state that
mining, excavating etc. If strasses are not Increased In adJolnln~
property - or - par. 6 - If grading Is done where established and
provided for by law, done In an Isolated suk contained area, or If
operation Is a permanent established operation, I would request the
Village Attorney give me an opinion on what constitutes "mining,
excavatln!etc. where established and prov, lded for by law" - Sec. 7003
par. 5, and also an opinion on what generally would qualify any area
In the Village as "Isolated and self contained" - as applied to Sec.
7003, par. 6. .
This operation Is at Its height during warm weather months and permit,
If required by Sec. 7003, should be readied for Issuance when load
limits are removed this spring. .

(2) The pond area on West side of Old Hwy 10 Just across from Llndey's
Steak House consists of fill being placed In pond from South end,
In apparent excess of 50 cu. yds. of fill allowed by par. 2, Sec. 7003
before permit 15 required. No activity Is evident at present, but
may be expected to resume In the spring or summer. If Clerks office
can provide the owners name and address I will contact him and Issue
the permit If the work benng done Is In compliance with Code.

(3) This S.W. corner of Rldgewood Road near Intersection with Edgewater
area, abuts the easterly line of the James Schacker residential pro-
perty, 1504 Edgewatar Ave. This past summer Mr. Schackef filled and
graded a quite deep, unkempt drainage ditch between his property and
Rldgewood Road. The fill placed by Mr. Schacker Is sloped to the
street and a Village Maintained collection spillway was unchanged.
A culvert maintains drainage unchanged and as this qualifies as a
self contained area I Informed Mr. Schacker no permit would be required.

Snelling Ave., East side of Lake Johanna, ApproxJ 3279 Old Snelling.
On this property a very long Access Drive leads In from Snelling. This
Is quite narrow and Inorganic fill has been placed along the North
Side for some distance. This fill was placed In stages as Inexpensive
fill became available, I would estimate at least 50 yards has been
placed to date. Since this Is the maximum amount allowed on anyone
lot without a permit being required, any future filling done In this
location will require a permit.

.

}

.

(4)

.
~l

.

REPORT BY CLAY KELLEY
RE: FILL AND GRADING

January 26, 1970

5)

Old Hwy 10 - East Side of Round Lake - Due to the snow cover I have
not checked this out but will do so as soon as conditions permit and
report at an early meeting.

In addition to these locations -
Fill has been placed on the S.E. corner of Cleveland and Co.
