ARDEN HILLS REGULAR CITY COUNCIL MEETING MINUTES JANUARY 26, 2004 4 . Ms, Michalak stated the right of way was very important to her. She asked ifthere would be any need to take any of her property. Mr. Brown stated her property should be okay, but there were properties where the road was not correctly aligned and in those cases, they would work with the City Attorney to obtain the appropriate right-of-ways. Steve Petry, 1146 Edgewater, asked about the watershed area and if anything had to be done or if it could be left as it was. Mr, Brown replied that as it currently was, the wetland area did not store the appropriate amount of water and the City wanted to improve its capacity. Mr. Petry stated he was on a comer lot and when he looked at the City's assessment policy, it appeared he would be assessed for 134 feet of frontage. He asked if this assessment policy applied to him considering he lived on a comer lot. Mayor Aplikowski replied it did apply to him. Mr, Moore noted he had the right to appeal any decision and staff would look at each appeal individually, but the current assessment policy would be applied. Mr. Petry asked if the assessments were spread out over 20 years. Mr. Parrish replied the last assessment the City did was for 10 years with interest.. . Gordy Dean, 3233 Shoreline Lane, stated the proposed construction did not go all of the way to the park and asked if he would be assessed all of the way to the park. Mr. Moore replied this would be a special case and he would have the right to bring it to Council, but they would start by assessing full frontage because he was benefiting by the access to the park. Mr. Dean stated he had worked with Mr. Landwer and he was very good to work with. Dave Munson, 1175 Edgewater, stated it appeared he would lose four feet of his driveway, which would make the driveway unusable for parking. He also noted the garage on the north end did not exist and the homes were set back farther than indicated. He asked the Council to look at the parking issues in driveways such as his. Mr. Brown stated this was an instance where the road was not properly lined up with the right-of-way and they would be working with the residents regarding this. He stated they hoped to keep the road where it was, but they would need to talk to those residents. He stated their intent was to keep things as they were today. Mayor Aplikowski asked if the Council would see a revised plan on this as these issues were worked out. Mr. Moore replied Council would see a revised plan. Mayor Aplikowski closed the public hearing at 8:00 p.m. . Councilmember Holden asked why the City was utilizing Lake Lane for City access to Ingerson Park. Mr. Moore replied the only way staff could maintain the lower level of the park was to come in through the back way since it was impossible to get back up to the upper level with the equipment due to the steep terrain.
