Section 1325.055 Subd. <br />5 allows for the removal of fewer than ten (10) percent of the caliper inches of significant trees on <br />the property without requiring mitigation, 2,198 for the Subject Property. The Applicant proposes <br />removing 3,702 caliper inches of trees, meaning the Applicant is responsible for mitigation of <br />1,504 caliper inches removed above 10 percent. Per Section 1325.055 Subd 6, the number of <br />caliper inches of trees required for replanting is determined at a rate of 1:2 or one inch replaced <br />for every two inches lost. The landscaping plan currently states trees of two caliper inches will be planted on the <br />site. <br /> <br />The submitted plans show plantings within drainage and utility easements. These plantings must <br />be moved outside of the easements. <br /> <br />The City Code requires a minimum of one tree be provided along the right-of-way for every 50 <br />feet of public street frontage. The Subject Property survey shows the property abutting County <br />Highway 96, Snelling Avenue North, and State Highway 10. Both the frontages along County <br />Highway 96 and Snelling Avenue North are heavily vegetated. Additional frontage along State <br />Highway 10 is currently less vegetated and will be impacted by construction. The Applicant is <br />proposing 38 trees along 398 feet of abutting right-of-way that will be disturbed along State <br />Highway 10. <br /> <br />E. Screening – Meets Requirements <br />Under Section 1325.05, Subd. 4, requires when any non-residential use in residential districts by <br />Conditional Use Permit or PUD, such as houses of worship and residential facilities over six <br />adjoins or is located across the street from any single- or two-family residential lot, screening is <br />required. All parking, loading service, utility, and outdoor storage areas shall be screened and <br />buffered from all public streets and adjacent differing land use. Screening exists for the house of <br />worship use on proposed Lot 2 and will not be altered. <br /> <br />Existing vegetation and proposed landscaping are proposed for screening from adjacent <br />residential uses for the proposed multiple family dwelling. Trash enclosures will be contained <br />within the underground parking lot, under the proposed building. <br />
