The existing property meets all the <br />minimum dimensional and area standards except for the 40 foot required corner side yard <br />setback. <br /> <br />The proposed addition would allow a condition that is consistent with the surrounding <br />development. The development the parcel is in was developed under stmdards different thm <br />current regulations would allow. The addition will not alter the essential character of the <br />neighborhood. <br /> <br />Ms. Randall advised that the Planning Commission recommended approval of Planning Case <br />#00-09, corner side yard variance (24 feet proposed, when 40 feet is required) for an addition, <br />based on the "Findings - Corner Side Yard Setback Variance" section of the staff report dated <br />Fcbruary 2, 2000, with the following condition: <br /> <br />I. If the structure is damaged in excess of the building code threshold for damage, the <br />variance would no longer be valid. <br /> <br />Councilmember Aplikowski asked if the proposed addition would require the removal of trees. <br />Ms. Randall stated that the majority of the trees will be preserved which was one intent behind <br />the proposed location of the addition. <br /> <br />MOTION: <br /> <br />Councilmember Grmt moved aJld Council member Aplikowski seconded a motion <br />to approve Planning #00-09, corner side yard variance (24 feet proposed, when 40 <br />feet is required) Cor an addition, based on the "Findings - Corner Side Yard <br />Setback Variance" section of the staff report dated February 2, 2000, with the <br />following condition: <br /> <br />1. If the structure is damaged in excess of the building code threshold for <br />damage, the varimce would no longer be valid. <br /> <br />The motion carried unanimously (5-0). <br /> <br />4. Case #00-10, HCM Arehitects, Tony Schmidt Park, 3500 Lake Johanna <br />Boulevard, Site Plan Review <br /> <br />Ms. Randall explained that the applicant was requesting approval of a site plan review (Phase 2 <br />construction) for planned upgrades to Tony Schmidt Park. <br /> <br />On February 23, 1998, the City Council approved the special use permit (Concept Approval) for <br />the redevelopment of Tony Schmidt Park. Ramsey County was proposing to redevelop in <br />several phases. On August 31, 1998, the City Council approved Planning Case #98-21, Site Plm <br />(Phase I construction). In 1999, Phase I construction was completed. They are now requesting <br />approval for Phase 2 construction. <br /> <br />During the Special Use Permit (Concept Plm) approval, Ramsey County had not progressed far <br />enough along in the design of this park to provide detailed drawings of what the beach house, <br />picnic shelters, and restrooms will look like. <br />
