Engineer Lund advised that the developer be requested to re- <br />submit this plat to the Rice Creek Yater Shed District for approval of the <br />changed drainage plan. <br /> <br />Attorney's Opinion Requested <br /> <br />. <br /> <br />Attorney Lynden was requested to advise the Council which ordinance prevails <br />when ordinance ~~endment8 are adopted after an application has been submitted, <br />whether each phase submitted for llppro,'al is considered all a ne'll application v <br />or if the initial application date is used throughout the development of tbat <br />parcel. <br /> <br />Stewart Lumber - Request re Sewer <br /> <br />Engineer Lund reviewed the req~est from Ste-.,art Lumber aud recommended that the <br />Council approve the reconstruction of the present drainfie!d, advising that the <br />extension of the municipal sanitary sauer line to serve this property would be <br />expensive; it wo~ld also necessitate jacking under a railway line. <br /> <br />Hollenhorst waved, asconded by Olmen, that the Council approve the reconstruction <br />of the private drainfield as requested; notion carried unanmously. <br /> <br />Lnmbros Ditch <br /> <br />Engineer Lund reviewed his letter of June 21, 1973, in which he described five <br />methods of restoring and protecting tbe ditch: <br /> <br />1. Line dit.ch with timber sheeting - $32,250 <br />2. Install storm S~Ner - $44,250 <br />3. Line ditch with corrugated metal sheets - $37,600 <br />4. Line ditch .dch steel sheet piling - $63,100 <br />5. Jim Hill cutplained that the Registered Property Abstracts have not been received <br />from North Star Abstract for Attorney Lyr~en's review, but requested that the Council <br />approve the agreements and tinal plat, subject to the Attorney's review of the <br />Registered Property Report. <br /> <br />-2- <br />
