<br />ARDEN HILLS CITY COUNCIL - JUNE 7, 1999 <br /> <br />2 <br /> <br />. <br /> <br />Mr. Fritsinger also updated Councilmembers on the status of the legislation regarding the <br />land transfer, with the House version scheduled to go to the floor on Tuesday, June 8, <br />1999, and the Senate version already approved, <br /> <br />Mr. Post and Mr. Fritsinger updated Councilmembers on their respective conversations <br />with Mr. Michael Fix, Minnesota National Guard Commander's Representative and <br />Environmental Engineer at the Twin Cities Army Ammunition Plant (TCAAP) site, and <br />Congressman Vento's office regarding additional agreements required and a timetable for <br />the City to access the proposed City Hall construction site. Mr, Fritsinger stated that <br />National Guard representatives would be reviewing more details of the agreement later <br />this week, and would notify City Hall of the outcomes of these conversations. <br /> <br />Mayor Probst alluded to the recent press conference, and the specific comments of Mr. <br />Paul Woodhouse, Leader, Operations and Management Team, Industrial Operations <br />Command, United States Army, regarding the transfer process. Mr. Woodhouse had <br />stated that an agreement would be required to cover the actual transfer, National Guard <br />use of facility, and other considerations. There was some discussion, but no actual <br />determination, of the City obtaining Right of Entry permission prior to the actual <br />agreements being signed. <br /> <br />. <br /> <br />Mr. Tom Lynch, a resident and former architect, 3220 North Hamline Avenne, <br />cautioned the City Council on signing a contract without a determined construction start <br />date, stating the City would be open to winter construction costs, and suggesting a Letter <br />of Intent be considered in order to hold the bids during the extension period. <br /> <br />Mr. Fritsinger stated that the May 24, 1999 letter from Rochon Corporation was not an <br />enforceable document, simply a "good faith" letter of the intent of the contractor. <br /> <br />Mr. Post and Mr. Fritsinger respectively outlined their specific conversations with City <br />Attorney Filla regarding the need for a formal agreement. <br /> <br />Councilmembers discussed the options available to the City, and the ramifications of <br />those various options. <br /> <br />MOTION: <br /> <br />Councilmember Malone moved, and Councilmember Aplikowski <br />seconded a motion to adopt Resolution No. 99-17 entitled, "Resolution <br />Extending Bid Acceptance Date," Motion carried unanimously (4-0). <br /> <br />ADJOURN <br /> <br />. <br /> <br />MOTIO~t ~C~, cilmember Malone moved and Councilmember Aplikowski seconded <br />~.
