Page 2 of 5 <br /> <br />Round Lake Senior Living. Currently, apartment and condominium complexes within the City <br />contract for their own recycling services; however, they may opt-in to the City’s Recycling <br />Program. <br /> <br />The City Attorney has reviewed the contractual language and had recommendations for edits. <br />Her changes were regarding the exclusion of future Rice Creek Commons development from this <br />contract, insurance requirements, and some general changes to definitions. These <br />recommendations have been incorporated in the language of the final agreement. A draft of the <br />proposed contract, as reviewed by the City Attorney, is included as Attachment A. <br /> <br />Contract Length <br /> <br />The City Council reviewed the proposal submitted by Walters and a draft contract (that mirrored <br />current contract) at the December 9 Work Session. At that meeting, Council directed Staff to <br />negotiate a 5-year contract with Walters. Upon Council approval, the City will enter into a five <br />(5) year contract for residential recycling services with Walters Recycling and Refuse, Inc. <br />beginning on May 5, 2025. <br /> <br />Contract Extensions <br /> <br />Council unanimously recommended pursuing a 5-year contract with the option to extend the <br />contract, if the City so chooses. Per contract language in Section 1.2: <br /> <br />The City at its sole discretion may elect to extend the Contract for one (1), three (3) year <br />extension. The terms and conditions of this Contract shall apply to any such Contract extension. <br />Nothing in this Contract shall be interpreted to imply or infer that the City is committing to such <br />extensions. <br /> <br />The three (3) year extension option was requested by Walters because annual extensions would <br />require the process and resources by either party to be repeated every 6-9 months after <br />notification of each extension. <br /> <br />Payment for Base Collection Services <br /> <br />This section of the proposed contract for the “base Contact prices” remains unchanged from the <br />rates previously presented to the City Council. <br /> <br />• The Contract prices set for recyclable collection services for RDUs: <br /> <br />Commencing May 5, 2025, the base Contract prices shall be $7.99 per eligible RDU per <br />month for weekly recycling service. Eligible RDUs with more than one (1) cart will be <br />charged an additional fee of $2.00 per household per month per cart. <br /> <br />It should be noted that the current recycling contract includes the same contract language <br />for the additional charge with more than one (1) cart. However, city staff has learned that <br />the current hauler has elected not to bill for additional carts. Walters has agreed not to bill <br />the $2.00 rate for additional carts until January 1, 2026 because of the contract timing and <br />when recycling fees need to be set.
