4 <br />TW185\1\1011577.v13 <br />A. The Developer becomes fee owner of the Subject Property and abides by all <br />terms of the purchase agreement for the Subject Property. <br />B. That the final plat and this Agreement have been recorded with the Ramsey <br />County Recorder and Ramsey County Registrar of Titles within sixty (60 <br />days) after the approval of the final plat for the Subject Property. <br />C. That the Developer meets the standards in the JDA Sustainability Design <br />Guidelines as approved by the JDA, as reflected in the attached Exhibit C. <br />D. That the Developer executes and records the Declaration of Restrictive <br />Covenants against the Subject Property in the form attached hereto as <br />Exhibit D. <br />E. That the Developer provide the Security (as outlined in Section 33) and <br />furnish the cash requirements (as outlined in Section 34). <br />F. That the Developer executes the Stormwater Maintenance Agreement in the <br />form attached hereto as Exhibit E. <br />G. That the Developer has obtained a temporary easement to construct the <br />Stormwater System Improvements and Water System Improvements which <br />easement shall be granted by the Ramsey County (the “Temporary <br />Easement”). <br />H. That the Developer constructs the Water System Improvements as depicted <br />in Exhibit B. <br />I. That the City of Arden Hils and the City of Mounds View have put in place <br />a fully executed Emergency Water Interconnect Agreement. Prior to
