16 <br />TW185\1\1011577.v13 <br />19. CLEAN UP. The Developer shall clean dirt and debris from streets adjacent to the <br />Project that has resulted from construction work by the Developer, subcontractors, their agents or <br />assigns. Prior to any construction at the Project, the Developer shall identify in writing a <br />responsible party and schedule for erosion control, street cleaning, and street sweeping. <br />20. PREVAILING WAGE. At the time of initial construction of the Project, <br />including the Infrastructure Improvements and any future tenant improvements to structures on <br />the Subject Property, will conform with the labor laws of the State of Minnesota, and all other <br />laws, ordinances, and legal requirements affecting the work in Ramsey County and Minnesota <br />including the Ramsey County Prevailing Wage Ordinance No. 2013-329 (“Ordinance”). <br />Notwithstanding the foregoing, labor for the Project shall not be required to be union labor. Failure <br />to comply with these requirements is a breach of this Agreement and, in addition, may result in <br />civil or criminal penalties. <br />In acknowledgement of this condition, Developer must provide an executed copy to the <br />JDA of the Prevailing Wage Certification, attached hereto as Exhibit H. <br />21. ENGINEERING AND ADMINISTRATION ESCROW. The Developer shall <br />pay a fee for administration, legal, and engineering administration to cover the direct costs for <br />professional services provided during the review, approval and inspection of the Development <br />Fees will be based on standard hourly rates provided by JDA staff, JDA legal advisors, and the <br />JDA’s consulting engineer. JDA engineering administration will include consultation with <br />Developer and Developer’s engineer on design, construction inspection and observation, <br />consultation regarding construction status or problems regarding the project, and coordination for <br />final inspection and acceptance.
