Crepeau Jr., Counci Imen James Wingert, <br />Charles Crichton, William Feyerelsen, stan Olmen. <br />Absent - None. <br />Also Present - Attorney James Lynden, Engineer Don Lund, Treasurer <br />Richard O'Kelly, Cle,-k Administrator Char-Iotte ~1cNiesh, <br />Deputy Clerk Dorothy Zehm. <br /> <br />-. <br /> <br />Aoproval of Mlnu~es <br />The Minutes of the Regular Council Meeting of February 11,1974, <br />were approved as amended. <br /> <br />~usiness from tQe Floor <br />None. <br /> <br />REPORT OF VILLAGE ATTORNEY JAMES LYNDEN <br /> <br />}olnt Powers Agreement - Lambros Ditch <br />Attorney Lynden reported that the County has approved of the Lambros <br />Ditch Joint Powers Agreement, subject to approval of the Rice Creek <br />Watershed District; matter to be on Rice Creek Watershed District <br />agenda on March 6 (plans and specs have been sent to Rice Creek Water- <br />shed by Engineer Lund). <br /> <br />Lynden reported that Rosevi I Ie had approved the Joint Powers Agreement; <br />Shoreview wil I consider the matter tonight; State of Minnesota wll I <br />not participate. In view of this, Lynden advised that Rosevilie, <br />Ramsey County and Shoreview have indicated they will agree to the in- <br />creased financial obligation which, according to formula, wi II be: <br />Arden Hills $6,768.07 <br />Shorevlew 2,846.82 <br />f{oseville 4,720.55 <br />Ramsey County 2,480.34 <br /> <br />Lynden recommended <br />lows: <br />I. <br />2. <br /> <br />that the Joint Powers Agreement be modified as fol- <br /> <br />Delete all reference to State of Minnesota. <br />Substitute new Paragraph 4 for existing one which new paragraph <br />sets forth real location of costs of the project. <br />3. Change 3 day to 7 day notification re decisions to be made <br />under contract documents. <br />4. Delete sentence In paragraph I requiring that contract docu- <br />ments not be executed unt! I Joint Powers Agree~ent is executed <br />by participating agencies. <br />Crichton moved, seconded by Olmen, that the Counci I approve the amended <br />Joint Powers Agreement as outlined by Attorney Lyndan, authorizing Its <br />execution by the Mayor and Clerk Administrator upon approval of the <br />agreement by the Rice Creek Watershed District. Motion carried unani- <br />mously. <br /> <br />-. <br /> <br />Crichton moved, seconded by Feyerelsen, that the Counci I approve and <br />authorize the Mayor and Clerk Administrator to execute the contract <br />documents with Northdale Construction Company upon approval of agree-, <br />ment by Rice Creek Watershed District. Motion carried unanimOUSly. <br /> <br />Ordinance No. 177 <br />"Aftorney Lynden i::"ead, in Its entirety, Ordinance No. 177, AN ORDINANCE <br />REPEAL I NG SECT IOH 2 OF ORD I NANCE NO. I! 0 AND At~END I NG ORD I NANCE NO. 83, <br />THE PERSONNEL ORDINANCE, BY ADJUSTING VACATION BENEFITS. <br /> <br />After discussion, Feyereisen moved, seconded <br />Counci I adopt Ordinance No. 177, as amended. <br />r.1ously. <br /> <br />by CriChton, that the <br />Motion carried unanl- <br /> <br />~.S.P. ~_~nder~~~d Electric Cable Proposal <br />Attorney Lynden referred to his letter of 2/21/74, and recommended <br />that the Council authorize him to prepare the agreement; authorizing <br />!ts execution by the Mayor and Clerk Administrator to be sent to NSP. <br />-1- <br />
