<br /> Page 2 of 6 <br /> <br /> <br />The retail sales and services definition at the time of approval read as follows: <br />- Retail sales and services: Stores and shops selling, renting or leasing goods for uses away <br />from the point of sale or offers services available on the premises. Includes the following: <br />antiques, art and school supplies, auto accessories, bakeries, bicycles (not motorized), <br />books, stationery, candy, camera and photographic supplies, carpets and rugs, china and <br />glassware, clothing and costume rental, custom dressmaking, department stores, drugs, dry <br />goods, electrical and household appliances, sales and repair, florist, food, furniture, furrier <br />shops, garden supplies (year-round operation only), gifts, hardware, hats, hobby shops, <br />interior decorating, jewelry, leather goods and luggage, locksmith shops, musical <br />instruments, office supply equipment, optometrists, paint and wallpaper, phonograph <br />records, shoes, sporting goods, tobacco, toys, variety stores, wearing apparel, and similar <br />type uses. Motor vehicle sales, motor vehicle leasing and rentals, exterior equipment rental <br />and sales lots, repair garages, pawn shops, and open sales lots are not included in this <br />definition of retail sales. <br />At the October 19, 2015 City Council Work Session, staff presented possible revisions to the <br />Zoning Code to address retail and resale businesses. Revisions were drafted after staff completed <br />research on the operational characteristics of thrift stores, such as receiving materials and <br />processing items for resale. Councilmembers discussed drafted changes and directed staff to <br />proceed with creating a separate land use category for resale businesses and to provide information <br />on in which zoning districts resale business uses could permitted and if this use would be permitted <br />by right or by conditional use permit. <br /> <br />At the December 21, 2015 City Council Work Session, staff shared two separate definitions to <br />clarify the difference between “Retail Sales and Services” and “Thrift Store” establishments. Staff <br />also shared drafted Conditional Use Permit criteria for Thrift Stores. Councilmembers were asked <br />to direct staff on which zoning districts should thrift stores be permitted, conditional or not <br />permitted. Following discussion, the City Council agreed that B-4 was the recommended Zoning <br />District that would permit Thrift Stores as a conditional use. <br /> <br />On February 3, 2016, the Planning Commission held the required public hearing for the zoning <br />amendments and voted to recommend approval of the proposed amendment with the addition of <br />the B-2, B-3, and I-Flex Zoning Districts that would permit Thrift Stores as a conditional use. <br /> <br />The drafted amendments were reviewed at the February 29, 2016 Regular City Council Meeting <br />and approved with amendments to remove thrift stores as a use permitted as a conditional use in <br />the B-2 and B-3 Zoning. At the meeting, staff discussed that existing thrift stores would be <br />grandfathered in the B-2 Zoning District. <br /> <br />Current Language <br />The Arden Hills Zoning Code defines Retail Sales and Service and Thrift Store separately. <br /> <br />- Retail sales and service. An establishment engaged principally in the sale or rental of <br />primarily new goods and the provision of services directly to the consumer, excluding those <br />uses defined more specifically in this Code.
