<br />. <br /> <br />. <br /> <br />. <br /> <br />ARDEN HILLS CITY COUNCIL - SEPTEMBER 14 1998 <br />, <br /> <br />10 <br /> <br />Me Brown stated money has been put aside for retaining walls to stay within the realm of the cost <br />trade off. <br /> <br />Ms, Walsh pointed out the south side of the road had been looked at as a potential trail site but <br />there would be more wetland issues and the tree stand by the bank would be a problem. <br /> <br />Councilmember Malone asked, if the grant money is accepted and the project is found to not be <br />feasible, can the money be given back. <br /> <br />Ms, Walsh stated is could be returned. <br /> <br />Councilmember Malone asked if there would be a penalty. <br /> <br />Me Fritsinger indicated there would not be a penalty, <br /> <br />MOTION: <br /> <br />Councilmember Aplikowski moved and Councilmember Keim seconded a motion <br />to approve Resolution #98-58, Accepting the Grant from the Minnesota <br />Department of Natural Resources Cooperative Trails Grant Program for Trail <br />Construction Along County Road F. The motion carried unanimously (5-0). <br /> <br />E. Abatement of3171 and 3183 North Lexington Avenue <br /> <br />Me Fritsinger noted that the City Council, at its August 10, 1998 meeting, adopted Resolution <br />#98-51 and Findings in regard to the "Hazardous Building" conditions present at 3171 and 3183 <br />North Lexington Avenue, The Council authorized commencement of the abatement proceedings <br />under Minnesota Statutes, <br /> <br />Since this meeting, the City Attorney and staff have been working through the legal process to <br />ensure the hazardous conditions are abated. Recently, the property owner, Me Andersen, began <br />a process whereby this property would be sold to a third party, Mr, Rekuski. <br /> <br />The City has held numerous meetings with the current and prospective property owners and their <br />attorneys, To facilitate the abatement with the new owner, an agreement has been reached with <br />all parties, including the following components: <br /> <br />Me Andersen will pay all legal/court/staff fees incurred to date by the City of Arden Hills. <br /> <br />Me Rekuski will board up/secure the home within five days of closing, <br /> <br />Me Rekuski will submit a plan within twenty days outlining his intentions for 3183 <br />Lexington Avenue and, within sixty days, complete abatement on said property. <br /> <br />Me Rekuski will escrow $20,000 that can be used by the City in case of default to <br />complete abatement. <br /> <br />Mr, Fritsinger stated one ofthe key points is that the house at 3171 North Lexington Avenue will <br />come down immediately and the owner wants to investigate whether the foundation can be reused <br />
