<br />. <br /> <br />" <br /> <br />t, , <br /> <br />MINUTES OF REGULAR COUNCIL MEET~NG <br />Village of Arden Hills <br />Monday, August 6, 1977 - 7:30 p.m. <br />Village Hall <br /> <br />Ca II to Order <br />Pursuant to due cal I and notice thereof, Mayor Crepeeu called the <br />meeting to order at 7:32 p.m. <br /> <br />. <br /> <br />Roll Call <br />Present - Mayor Henry J. Crepeau, Jr., Councilmen James Wingert, <br />Robert Woodburn, Ward Hanson, Charles Crichton. <br />Absent - None. <br />Also Present - Attorney James Lynden, Engineer Donald Christoffersen, <br />Planner Orlyn Miller, Treasurer Donald Lamb, Clerk Adminis- <br />trator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. <br /> <br />Approval of Minutes <br />Woodburn moved, seconded by Wingert. that the Minutes of the Regular <br />Council Meeting ot July 25. 1977, be approved as amended. Motion <br />carrIed unanimously. <br /> <br />Business from the Floor <br />None. <br /> <br />1EPORT OF VILLAGE ATTORNEY James Lynden <br /> <br />Status of EAW for Chatham <br />Lynden referred Council to his letter of 8-4-77 to the Environmental <br />Quality Board, re Chatham Subdivision, describing the City's reasons <br />for Its request for an exemption from the preparation of environmental <br />documents for the Chatham development. Lynden reported that he, <br />Engineer Christoffersen and Hans Hagen (BanCon) will attend the <br />Environmental Quality Board Meeting on lues, August 9th when the City's <br />request for exemption will be considered; will request that work on <br />the project be al lowed to continue, if It is determined that the EAW <br />Is required; EAW has been prepared and will be submitted to EQB at <br />the meeting, If the exemption Is not granted. <br /> <br />Christoffersen advised that, as the result of revocation of the PCA <br />permit, he has directed the contractor (Houle) to cease work on the <br />project; noted that a Change Order wll I be forthcoming, because of the <br />construction delay. <br /> <br />After discussion, Wingert moved to ratify previous Councl I action, <br />authorizing Attorney Lynden to file the Negative Declaration for EIS, <br />and authorizing execution of same by the Clerk Administrator on behalf <br />of the City. MotIon was seconded by Hanson and carried unanimOUSly. <br /> <br />EAW - KarthLake Estates <br />Wingert moved, seconded by Crichton, that Council authorize a Negative <br />Declaration for an EIS for Karth Lake Estates development; authorize <br />execution and filing of same by the Cierk Administrator. Motion <br />carried unanimOUSly. <br /> <br />Request for Reimbursement re Fire Line Instailedat Llndey's Steak <br />House <br />Lynden referred Council to memo from Public Works Supervisor Hans <br />Johanse~ and to his letter of 8-8-77 re Widmer Bros., Inc. vs. City <br />of Arden Hills. Banister, Short et al. <br /> <br />. <br /> <br />After discussion, Woodburn moved, seconded by Crichton. that Council <br />authorize Attorney lynden to advise Widmer Bros, Inc. et al that the <br />Clty declines any responsibility or liability In connection with the <br />fire line Installation at Llndey's Steak House. Motion carried unani- <br />mously. <br /> <br />Speed Limit in Mobile Home Parks <br />Lynden referred Council to his letter of 8-8-77, noting that Minnesota <br />Statutes, Subd. I of Sec. 327.24 provides that "It shall be unlawful <br />for any type vehicle to traveU et a rate In excess of 10 mph while <br />within the limits of a mobile home park or recreational camping area <br />and such 10 mph limit shall be clearly posted throughout the mobile <br />home park." Lynden noted that enforcement of the speed limit Is the <br />duty of the State Department of Health; therefore, It does not appear <br />that the City of Arden Hills is responsible for enforcement of the <br />speed limIt. <br /> <br />-f- <br />
