Crepeau, Jr., Councilmen Robert Woodburn, <br />James Wingert, Charles Crichton. <br />Absent - Councilman William Feyerelsen. <br />Also Present - Attorney James lynden, Treasurer Donald lamb (7:45 p.m.), <br />Clerk Administrator Charlotte McNlesh, Deputy Clerk Dorothy <br />Zehm. <br /> <br />. <br /> <br />BUSINESS FROM THE FLOOR <br /> <br />None. <br /> <br />REPORT OF VIllAGE ATTORNEY JAMES lYNDEN <br /> <br />Arsenal Excavatin~ <br />lynden referred Counci I to his letter of March 15, 1976, re Excava- <br />tion Activities of Arsenal Sand and Gravel Company at TCAAP. <br /> <br />After discussion, Council generally concurred that CouncIl's concern <br />Is to protect the total environment of. the City; until it is known <br />that environmental Impact is detr1mental, no action to be taken. <br /> <br />Pedestrian Trails over NSP Rights-of-way <br />Lynden referred Council to his letter of 3/4/76 re Pedestrian Trails <br />.ver NSP r.lghts-of-way, advising that NSP would have no objection to <br />the City's use of NSP rights-of-way for pedestrian trail purposes, <br />but NSP cannot grant the right for such purposes where NSP only has <br />an easement Interest In the right-of-way. <br /> <br />After discussion, Wingert moved, seconded by Crichton, that Council <br />authorize lynden to determine ownership of the two rights-of-way <br />(north of Floral Park, from Snelling to Hamline, and west from <br />Cummings Park to Hamllne). Motion carried unanimously. . <br /> <br />(Buckley was requested to report re grants currently available for <br />trails .) <br /> <br />Editorial Conference,- Or.dlnance Codification <br />Lynden referred to his letter of March 9, 1976, re Arden Hills' <br />Codification Project, and reviewed his proposed answers to the <br />several questions which were raised during the editorial conference: <br /> <br />I. Fire Protection - to Include the Open Burning Ordinance <br />in the City Code, but to delete the Explosives Ordinance, <br />pending in-put from Police and Fire Chief. <br /> <br />2. Service Stations - After discussion Councl I concurred to <br />delete regulations limiting number of service stations <br />from the Licensing Ord. (No. 132), and to Incorporate regu- <br />lations re servIce station land use in the Zoning Ordinance. <br /> <br />. <br /> <br />3. Offenses - to Incorporate by reference pertinent provisions <br />of Chapter 152 of Minnesota Statutes and to delete Ords. <br />21 and 156. <br /> <br />4. <br /> <br />Advertlsln? - After review of proposed provisions control- <br />ling the d strlbutlon of "handbills", Council determined <br />that "handbills" control is not a problem now; asked lynden <br />to hold proposed regulations In abeyance; not Include In <br />Ordinance Codification at this time. <br /> <br />5. Plumbing and Utilities - Council referred comparison of <br />ordinance overlaps with State Building Code to W. West and <br />R. McNlesh to determine how much of Village Ordinances can <br />be deleted. <br /> <br />-1- <br />
