<br />Minutes of Regular 28, 1981 . <br /> Council Meeting Dec. . <br /> , <br />OTHER BUSINESS <br />Resolution No. 81-88, Approving Agreement with Ramsey County for <br />Lew Enforcement Servi ce s for the Year 1982. <br />In discussion, MeN iesh explained that the resolution <br />approves conditions to be adde d to the standard Law Enforcement <br />Ag reemen t and authorizes execution thereof; reported that the <br />agreement ie identical to the ag reemen t City hsd before, and r - <br />attached thereto is the estimated 1982 cost of the cOn t rac t I' <br />using the mileage rate of 35~/mile because the re are sufficient <br />monies in the Arden Hi lls fund for car replacement and mainte- <br />nance; noted that the pro-rated share of two sergeants is in- <br />cluded, but may not be implemented immediately. McNiesh noted <br />that this is an estimated contract; City will be billed for the <br />actual cos t; noted that. historically the cost has been less than . <br />estimated. <br />Ho11enhorst moved, seconded by McAllister, that Council adopt <br />Resolution No. 81-88, A RESOLUTION APPROVING AGREEMENT WITH <br />COUNTY OF RAMSEY FOR LAW ENFORCEMENT SERVICES FOR THE YEAR 1982. <br />Motion carried unanimously (3-0) . <br />Request to Attend Institute for Building Officials - Larry <br />Squires <br />McAllister moved, seconded by Hollenhorst, that Council authorize <br />Building , the Institute for Build- <br /> Inspector Squires attendance at <br />ing Officials , of 12-18-8l. Motion carried <br /> as per Squires memo <br />unanimously (3-0) . <br />(Councilman Johnson arrived - 8:00 p.m.) <br />REPORT OF VILLAGE ATTORNEY JAMES L YN DEN <br />(con t inue d) <br />Case No. 81-23, Derrick Land Company, Opinion re Proposed <br />Development Agreemen t end Spread of As sessmen ts <br />Council was referred to Lynden's letter of 12-17-81. Lynden re- <br />ported that Popovich advises that the City cannot amortize the <br />assessments ove r a 15 year period with a 7-year balloon as sug- <br />gested by developer Laughinghouse; the re is nothing in the law <br />tha t would allow for a balloon. <br />Laughinghouse said it would be in the Ci ty' s interest to s p re ad <br />the assessments over 10 to 15 years which would make the lots <br />more effordable and therefore would sell faster. <br />In discussion, it was sugges ted that the City could possibly re- <br />quire that special assessments be paid at time of closing or prior <br />to occupancy (ame n d City Code to this effect or req ui re that it <br />be included in purchase agreement when lots are sold) . <br />Af te r discussion, Council concurred that Lynden prepare a draft <br />of a development ag reemen t for Arden Oaks (Derrick Land Comp any) <br />for Council cons ide ra t ion, which includes the conditions outlined <br />by Attorney Lynden, as well as the provision that all special <br />assessments be paid prior to occupancy of homes in the develop- <br />ment; the spread of asses smen ts to be ove r a 10-year period unless . <br />a longe r time is recommended by Popovich. <br />Motorola Tower Park Dedication - Status Report <br />Lynden reported that Mr. Vaughan is prepari ng a park dedication <br />easemen t to be signed by Winiecki and Vaughan; easement has not <br />been received to date; note d that th e eas emen t is a requirement of <br />the Special Use Permit. .. .. <br />REPORT OF VILLACE ENCINEER DONALD CHRISTOFFERSEN <br />Consideration of Bids for Impr. No. P81-1, Crey Fox Road - Reso- <br />lution No. 81-90, Awarding Bid for Imrp. No. 81-1 <br />Council was referred to tabulation of bids received 11-18-81. It <br />was note d by Christoffersen that C.S.
