<br /> , . -. <br /> Minutes of Regular Council Meeting <br /> Village of Arden Hills <br /> Monday, December 14, 1981 - 7 : 30 p. m. <br /> Village Hall <br /> Call to Order <br /> Pursusnt to due call and notice thereof, Mayor Woodburn called <br /> the meeting to order at 7:35 p.m. <br /> Roll Call <br /> Present - Mayor Robert Woodburn, Councilmen Janet Hollenhorst, <br /> Diane McAllister, Maurice Johnson. <br /> . Absent - Councilman Jsmes Wingert <br /> Also Present - Village Attorney James Lynden <br /> Village Engineer Donald Christoffersen, Treasurer <br /> Don aId Lamb, Clerk Administrator Charlotte McNiesh, <br /> Deputy Clerk Dorothy Zehm. <br /> Approval of Minutes <br /> Hollenhorst moved, seconded by Johnson, that Council approve the <br /> Minutes of the November 30th Council Meeting as amended. Motion <br /> carried unanimously (4-0) . <br /> Business from the Floor <br /> None <br /> REPORT OF VILLAGE ATTORNEY JAMES L YN DEN <br /> Resolution No. 81- 86 , Vacatinll: Certain Roads in Shady Oaks Addition <br /> Council was referred to Lynden' s letter of 12-10-81 re Case No. <br /> 81-23, and to an amended draft of Resolution No. 81- 86, correcting <br /> the legal description of roads to be vacated in Shady Oaks Addi- <br /> tion, prepared by Arden Oaks surveyor. <br /> McAllister moved, seconded by Johnson, that Coun ci 1 adopt Resolu- <br /> tion No. 81- 86 , A RESOLTUION VACATING CERTAIN ROADS LOCATED IN THE <br /> PLAT OF SHADY OAKS ADDITION. Motion carried unanimously (4-0). <br /> Opinion re Village Possible Involvement in Contaminated Water <br /> Lawsuit <br /> Council was referred to Lynden's letter of 12-7-81 and attachments <br /> thereto. Lynden explained that his opinion is that the Ci ty does <br /> not have a cause of action agains t the contamination because the <br /> City has no municipal water wells; re lies instead upon a water <br /> system that is not reliant upon municipal wells; noted that private <br /> land owners, whose wells have been contaminated, have a cause of <br /> action for civil damages. <br /> Council concurred with the Attorney's opinion and authorized Clerk <br /> Administrator McNiesh to send a copy of Attorney Lynden's opinion <br /> to New Brighton. <br /> State Statute vs. City Code - Time Requirement for Filing Final <br /> Plat <br /> . Council was referred to Lynden's letters of 12-10-81 and 12-14-81 <br /> re Time Within Which to Record Final Plat After Approval by City <br /> and Time Within Which to Prepsre Final Plat After Approval of Pre- <br /> liminary Plat by Ci ty. <br /> Lynden explained that the City has no t amended its subdivision <br /> Ordinance since August 1 , 1980 : therefore may choose not to come <br /> into compliance with the provisions of Statute 462.358 until such <br /> time the subdivision ordinance is next amended. <br /> Lynden noted that the Arden Hi lls Code requires that the final <br /> plat be filed within 3 months of approval of the preliminary plat, <br /> and that the final plat be recorded within 60 days after approval <br /> thereof. <br />
