, . -. Minutes of Regular Council Meeting Village of Arden Hills Monday, December 14, 1981 - 7 : 30 p. m. Village Hall Call to Order Pursusnt to due call and notice thereof, Mayor Woodburn called the meeting to order at 7:35 p.m. Roll Call Present - Mayor Robert Woodburn, Councilmen Janet Hollenhorst, Diane McAllister, Maurice Johnson. . Absent - Councilman Jsmes Wingert Also Present - Village Attorney James Lynden Village Engineer Donald Christoffersen, Treasurer Don aId Lamb, Clerk Administrator Charlotte McNiesh, Deputy Clerk Dorothy Zehm. Approval of Minutes Hollenhorst moved, seconded by Johnson, that Council approve the Minutes of the November 30th Council Meeting as amended. Motion carried unanimously (4-0) . Business from the Floor None REPORT OF VILLAGE ATTORNEY JAMES L YN DEN Resolution No. 81- 86 , Vacatinll: Certain Roads in Shady Oaks Addition Council was referred to Lynden' s letter of 12-10-81 re Case No. 81-23, and to an amended draft of Resolution No. 81- 86, correcting the legal description of roads to be vacated in Shady Oaks Addi- tion, prepared by Arden Oaks surveyor. McAllister moved, seconded by Johnson, that Coun ci 1 adopt Resolu- tion No. 81- 86 , A RESOLTUION VACATING CERTAIN ROADS LOCATED IN THE PLAT OF SHADY OAKS ADDITION. Motion carried unanimously (4-0). Opinion re Village Possible Involvement in Contaminated Water Lawsuit Council was referred to Lynden's letter of 12-7-81 and attachments thereto. Lynden explained that his opinion is that the Ci ty does not have a cause of action agains t the contamination because the City has no municipal water wells; re lies instead upon a water system that is not reliant upon municipal wells; noted that private land owners, whose wells have been contaminated, have a cause of action for civil damages. Council concurred with the Attorney's opinion and authorized Clerk Administrator McNiesh to send a copy of Attorney Lynden's opinion to New Brighton. State Statute vs. City Code - Time Requirement for Filing Final Plat . Council was referred to Lynden's letters of 12-10-81 and 12-14-81 re Time Within Which to Record Final Plat After Approval by City and Time Within Which to Prepsre Final Plat After Approval of Pre- liminary Plat by Ci ty. Lynden explained that the City has no t amended its subdivision Ordinance since August 1 , 1980 : therefore may choose not to come into compliance with the provisions of Statute 462.358 until such time the subdivision ordinance is next amended. Lynden noted that the Arden Hi lls Code requires that the final plat be filed within 3 months of approval of the preliminary plat, and that the final plat be recorded within 60 days after approval thereof.
