Hollenhorst moved, <br />seconded by Woodburn, that Council deny the Special Use Permit for <br />the wind generator. Motion carried (Hollenhorst, Johnson, Woodburn <br />voting in favor of the motion; McAllister voting in opposition). <br /> <br />Case No. 81-10. Setback Variance for House and Case No. 81-12, ~ <br />Preliminary Plat - Christianson 1st Addition and Setback Variance <br />Council was referred to Board of Appeals report (3-31-81) Planning <br />Commission Minutes of 5-6-81 and to Planning Memo (4-21-81). <br /> <br />Miller explained thst the applicant is simultaneously requesting <br />vacation of the service drive at Ha..line Avenue, which he intends <br />to add to Lot 3, the area proposed for grading for storm water <br />storage. <br /> <br />Miller reported that the Board of Appeels and Planning Com..ission <br />reco....end approval of the 30' setback on all 4 lots (3-10t sub- <br />division - Case 81-12, and lot previously created esst of the sub- <br />division - Case 81-10). <br /> <br />Johnson asked the depth of the water storage area after proposed <br />arading. Engineer Sunde .aid it will be 6" below the present <br />water level, which is about 2' below the invert at Hamline at pre- <br />sent. <br />-;ttf..l<-Zl~ , <br />Sunde noted that a drainage canal to the . extends about <br />40' into the swa..p; was apparently constructed to drain tha swa..p <br />at sOme previous time. Sunde said that when the volu..e of water <br />exceeds the pipe capacity at Hamline Ave., water will fill the <br />marsh, as it does now. <br /> <br />McAllister asked sbout the easement over the wetland area. Sunde <br />explained that this is required by RCWD. Woodburn noted that it is <br />very unusual for RCWD to take an easement; suggested a covenant <br />ease..ent to assure maintenance of the wetlsnd storage area would be <br />desirable. <br /> <br />Miller noted that it is the opinion of the applicant's attorney <br />that the vacated service drive will revert to Christisnson. <br /> <br />Hollenhorst moved, seconded by McAllister, that Council approve the <br />Preliminary Plat of Christianson 1st Addition with the following <br />contingencies: <br /> <br />1. Final grading plan approval by the City Engineer. <br />2. Vacation of 40' wide service road and its consolidation <br />with Lot 3. <br />3. Excavation plan prior to final plat to be subject to <br />approval by the City Engineer. <br />Motion carried unanimously. <br /> <br />~ <br /> <br />It was noted that vacation procedure may take some time to accom- <br />pliSh, possibly a month or two. <br /> <br />McAllister moved, seconded by Holl~nhorst, that Council approve a <br />30' front setback (10' variance) on all 4 Lots, to provide for <br />limited usable rear yards.
