<br />. <br /> <br />. <br /> <br />, <br /> <br />~inutes of Regular Council Meeting <br />Page Tuo' <br /> <br />Fehruary 25, 1980 <br /> <br />which applicant proposes to split into 2 parcels: <br />1. a 14,000 sq. ft. lot for existing house, and <br />2. an 11,905 sq. ft. lot for proposed new bouse. <br /> <br />Wingert explained that. health problem, produced by the existing <br />home, is the hardship described by the applicant which cannot be <br />resolved in the existing house; only alternative is for applicant <br />to move or build a new home on the site. It was explained that <br />the newly created lot is lesa than the required 14,000 sq. ft. area <br />and is 90' instead of 95' wide at the building line. Wingert ex- <br />plained that the applicant's attemptJ to purchase additional land <br />have been refused by the County and adjacent neighbors. <br /> <br />In discussion, Crepeau noted that the County has not been doing <br />very much pumping in recent years; feels that, in time, the County- <br />owned property (2,108 sq. ft.) will revert bac~, which will then <br />eliminate the need for either an area or lot width variance. <br /> <br />Wingert explained that, visually, it appears that the County pump <br />property is part of proposed lpt; technically the lot is non- <br />conforming; purpose of planning is to avoid crowding of houses <br />and changing number of people/acre: if County had not taken the <br />property (or if County had an easement for the pump) both lots <br />would meet area requirements of 14,000 sq. ft. <br /> <br />Hanson moved that Council grant the necessary variances and approve <br />the lot aplit as requested. Motion was seconded by Crichton and <br />carried. (Hanson, Wingert, Crepeau voting in favor of the motion; <br />Crichton and Woodburn voting in opposition.) <br /> <br />(CouDcil determined that the rear lot line of the proposed newly <br />created lot is the line at the lake.) <br /> <br />Case No. 79-4, Final Plat - Land 0' Lakes <br />Mr. Roland Dant, Land 0' Lakes, reported an easement error on the <br />proposed final plat and indicated its actual location which will <br />be corrected. <br /> <br />Wingert moved, seconded by Hanson, that Council approve the Final <br />Plat of Land 0' Lakes with the following contingencies: <br />a. Favorable title opinion by City Attorney, <br />b. Satisfactory re-wording of the landscaping Letter of Credit, <br />c. Re-draft of the Final Plat to correct utility easement. <br />Motion carried unanimously. <br /> <br />Wingert moved, seconded by Woodburn, that Council adopt Resolution <br />No. 80-10, vacating two existing easements, documents numbered <br />483139 and 534317 (To be filed simultaneously with Final Plat.). <br />Motion carried unanimously. <br /> <br />Council concurred that the park dedication be resolved prior to <br />building occupancy. <br /> <br />(Crepeau left the meeting.) <br /> <br />guit Claim Deed - Correcting Deacription of MSI Storm Sewer Easement <br />WingerJo~~y~ft~t~~t$~~Uft~~ approve the Quit Claim Deed and authorize <br />its e~~~ the City. W. Houle.
