<br />. <br /> <br />Arden Hills Council <br /> <br />6 <br /> <br />March 30, 1992 <br /> <br />t;:Q1:Jl'!i:::I 1__CQMMEN'l' s <br /> <br />-::9tL!>l.'r'': ?01'.ILE SAFE:TY_COJ~C~RNS <br /> <br />Councilmember Hicks stated that at a recent Parks meeting, <br />residents brought :orth County Road E safety concerns; he <br />anticipated those concerns will be forwarded to Council with <br />a recommendation l-elating to the conCe~~!lS. <br /> <br />'I'_t.lENJ;:E.s...i:::F!bEI TAUE:__Q)\11]>LINQ_I'EE}1JSE.l.'J;amJ 'I' <br /> <br />ccuncilmember Hicks referred to a March 27 1992 lette~ fraIT <br />Turner s Gymnast ics Center and asked l'.t torney Fi 11 a to <br />comment on whether Turners Gymnastics :8 in compliance with <br />charitable gambling regulatj,ons. <br /> <br />Attorney Filla stated that Turners, as a condition of thei~ <br />c~aritable ';1ambling operation permit must, 1) Be a non- <br />profit organization, 3) Use 50% of expenditures ,- the trade <br />area, 3) Meet the statetg definition of "lawful purpose". <br />He stated that in his judgment, Turners has not met those <br />conditions and he has contacted representatives of Turners <br />in this regard. <br /> <br />. <br /> <br />Filla fur~her ~ammented that he did net think the problem <br />with T~rners was in any way created by the CitYl that <br />Tllrners was well aware ~f the ~onditions of the permit. He <br />recommended that. since conditions have not been met, Council <br />withdraw the Cj_ty's a;praval of the permit and advise the <br />Charit.able Gambling Control Board of the action. <br /> <br />Councilmember- MahoTr'1ald commented that st:.ch acti,on would <br />require Turners to halt their operation. He asked if it <br />would be appropriate for the City to designate a time period <br />for investigat.ion rat.her than take act.ion to wit.hdraw <br />Turners' permit at this t.ime. Filla reiterated that <br />conditioDZ of the permit were clear and the organization is <br />not in compliance. <br /> <br />Mayor Sather added that he thought Turners charitable <br />gambling permit expires on or about 3/31/92 and he was <br />disappointed that Turners waited until the elevent~ hour to <br />report expenditures which do not appear to be accept.able. <br /> <br />. <br /> <br />-::c,tu:ci 1 member Hi cks asked 0::0u:1361 if t.here ,;,;ou} d be a time <br />period. in which Turners cculcl "appeal", Attorney Filla said <br />h.e was not aware of any "appea:'. Fi 11 a furt~1er <br />commented that Turners was asked to report their <br />expenditures well in advance of the expiration date of their <br />permit and they did not respond until March 27, 1992. <br />
