She indicated Charitable Gambling has changed substantially over the last few years and the organization has bad to make an effort to understand the letter of the laws. Councilmember Mahowald thanked the Turner's organization for the good faith efforts to bring this matter to a resolution. Mahowald asked the City Attorney if the proposal meets State Statute requirements. Attorney Filla indicated the payments should have occurred within calendar year 1991, however, if the City accepts the promissory note and payment occurs prior to the State license renewal period, the organization would be in compliance with the Ordinance regulations. There was discussion regarding language which should be included in the promissory note to insure the City is protected and state approval does not occur prior to payment of the note. Attorney Filla explained the agreement should include language that indicates if the promissory note is not paid in full, Turner's would withdraw the State application for a premise permit. • Mahowald moved, seconded by Growe, to adopt Resolution No. 92-06, APPROVING CHARITABLE GAMBIMZ PREMISE PER!vUT APPLICATION, St. Paul Turner's Gymnastic society, for Class A Bingo operations at Pot-O-Gold Hall, conditioned upon the organization entering into an agreement with the City of Arden Hills to provide an additional $20,000.00 payment for lawful purposes within the Arden Hills trade area, pursuant to the State statute, by March 20, 1992, and agree to withdraw its 1992 State application for premise permit if the additional contribution is'anot made by the established date and waive any notice requirements on administrative hearings. Motion carried unanimously. (5-0) RES. #92-05; Council was referred to the memorandum from the Clerk ORDER FEASIBILM Administrator dated 1-9-92, and attached correspondence RPT.; KEITHSONI POND regarding the Keithson Pond Improvements. Engineer Graham reviewed his letter dated January 8, which outlines the proposed improvements for the pond and estimated construction costs. He explained the attached design report was forwarded to the Rice Creek Watershed District for review. Graham recommended the City receive bids for the project, based on the complexity of the project, and in order to review firm construction cost figures for discussion purposes when considering the improvement. He further recommended the bidding process allows the City to keep all options open for funding the project. Graham advised the City Attorney received a request from the members of the • committee appointed to review the condemnation of the Reiling property to stake the pond area.
