<br />. <br /> <br />. <br /> <br />. <br /> <br />Minutes of the Arden Hills Regular CbunCil Meeti.n:J, 1-13-92 <br />Page 3 <br /> <br />PERMIT (Cant'd) Bronzel advised the organization is confident the <br />expenditure requirements will be met in a timely fashion <br />in 1992; explained the organization is not comfortable operating in this fashion. <br />She indicated Olaritable Gambling has changed substantially over the last f_ <br />years and the organization has had to make an effort to understaIrl the letter of <br />the laws. <br /> <br />eouncilmember Mahowald thanked the ~'s organization for the good. faith <br />efforts to bring this matter to a resolution. <br /> <br />Mahowald asked the city Attorney if the proposal meets state statute <br />requirements. <br /> <br />Attorney Filla indicated the payments should have occurred within calendar year <br />1991, however, if the city accepts the promissory note and payment occurs prior <br />to the state license renewal period, the organization would be in canpliance with <br />the Ordinance regulations. <br /> <br />There was discussion regarding language which should be included in the <br />promissory note to insure the City is protected and state approval does not occur <br />prior to payment of the note. <br /> <br />Attorney Filla explained the agreement should include language that indicates if <br />the promissory note is not paid in full, ~'s would withdraw the state <br />application for a premise pennit. <br /> <br />Mahowald moved, secon:ied by Growe, to adopt Resolution <br />No. 92-06, APPROVING CHARITABLE GAMBLING PREMISE PERMIT APPLICATION, st. Paul <br />Turner's GymnaStic Society, for Class A Bingo operations at Pot-o-Gold Hall, <br />conditioned upon the organization entering into an agreement with the city of <br />Arden Hills to provide an additional $20,000.00 payment for lawful purposes <br />within the Arden Hills trade area, pursuant to the state statute, by March 20, <br />1992, and agree to withdraw its 1992 state application for premise pennit if the <br />additional contrihltion is.@)not made by the established date and waive any <br />notice requirements on administrative hearings. Motion carried unaniloously. (5-0) <br /> <br />RES. #92-05; <br />ORDER FEllSIBILITY <br />RPl'.; KEI'IHSON POND <br /> <br />CbunCil was referred to the memorandum from the Clerk <br />Administrator dated 1-9-92, and attached correspondence <br />regarding the Keithson Pond Inprovements. <br /> <br />Engineer Graham reviewed his letter dated January 8, which outlines the proposed <br />llnprovements for the pond and estimated construction costs. He explained the <br />attached design report was forwarded to the Rice Creek Watershed District for <br />review . <br /> <br />Graham recommended the City receive bids for the project, based on the complexity <br />of the project, and in order to revi_ finn construction cost figures for <br />discussion purposes When considering the inprovement. He further recammended the <br />bidding process allows the city to keep all options open for funding the project. <br /> <br />Graham advised the City Attorney received a request from the members of the <br />camnittee appointed to revi_ the corrlemnation of the Reiling property to stake <br />the pond area. <br />
