D. On December 2, 2024 Spectrum Sign Systems, Inc. (the "Applicant") submitted an <br />application requesting approval of an Amendment to the PUD Development Contract to allow for <br />an increase in the amount of sign area permitted for auxiliary signs and allow for flexibility of <br />commercial text on the sign faces on the Property. As stated in the application and project narrative <br />submitted, the purpose of the requested is to direct traffic and maintain safety through clear signage <br />for direction of the site, which will not impact the surrounding area. <br />E. For adjustments to the requirements and standards for the height, number, type, <br />lighting, area, and/or location of a sign or signs not included on the approved PUD Development <br />Contract, an Amendment to the PUD Development Contract is required. <br />F. Pursuant to paragraph 33.E of the PUD Development Contract, all amendments to <br />the PUD Development Contract shall be in writing, signed by the parties, and approved by written <br />resolution of the City Council. <br />G. The City council has reviewed and approved the proposed application submitted by <br />the Applicant, and co -signed by the Developer. <br />NOW, THEREFORE, in consideration of the premises and the mutual obligations of the <br />parties hereto, the parties agree as follows: <br />1. All conditions of the original Preliminary/Final Plat, Planned Unit Development, <br />Conditional Use Permit, Site Plan Review, and their corresponding resolutions shall remain in full <br />force and effect. <br />2. The project shall be subject to any and all conditions of approval of Resolution <br />2025-016. <br />3. A violation of any condition set forth in the permit shall be a violation of the City <br />Code, and shall be cause for revocation of the permit. <br />4. A separate sign permit shall be required for all proposed signs. <br />5. The final location of auxiliary signs shall be subject to the approval of the PW <br />Director/City Engineer and shall comply with comments as provided within the application review. <br />6. The proposed signs shall conform to all other regulations in the City Code. <br />7. The Applicant will meet with the Developer to discuss granting an easement to the <br />City or Arden Hills for gateway signage to be installed along 694-35W or consider adding City of <br />Arden Hills to any monument sign planned for the future and provide written documentation by <br />March 30, 2025. <br />IN WITNESS WHEREOF, the parties have caused this Amendment to be executed as of <br />the date and year first above written. <br />0) <br />
